Dear Mr. McCollum:
The Nuclear Regulatory Commission has issued the enclosed Amendment Nos. 328, 328, and 329 to Renewed Facility Operating Licenses DPR-38, DPR-47, and DPR-55, respectively, for the Oconee Nuclear Station, Units 1, 2, and 3. The amendments consist of changes to the Technical Specifications in response to your application dated July 11, 2002.
The amendments are administrative in nature and incorporate several editorial changes.
A copy of the related Safety Evaluation is also enclosed. A Notice of Issuance will be included in the Commissions biweekly Federal Register notice.

The facility will operate in conformity with the application, the provisions of the Act, and the rules and regulations of the Commission; C. There is reasonable assurance (i) that the activities authorized by this amendment can be conducted without endangering the health and safety of the public, and (ii) that such activities will be conducted in compliance with the Commissions regulations set forth in 10 CFR Chapter I; D. The issuance of this amendment will not be inimical to the common defense and security or to the health and safety of the public; and E. The issuance of this amendment is in accordance with 10 CFR Part 51 of the Commissions regulations and all applicable requirements have been satisfied.
- 2. Accordingly, the license is hereby amended by page changes to the Technical Specifications as indicated in the attachment to this license amendment, and Paragraph 3.B of Renewed Facility Operating License No. DPR-38 is hereby amended to read as follows:
B. Technical Specifications The Technical Specifications contained in Appendix A, as revised through Amendment No. 328, are hereby incorporated in the license. The licensee shall operate the facility in accordance with the Technical Specifications.

SAFETY EVALUATION BY THE OFFICE OF NUCLEAR REACTOR REGULATION RELATED TO AMENDMENT NO. 328 TO RENEWED FACILITY OPERATING LICENSE DPR-38 AMENDMENT NO. 328 TO RENEWED FACILITY OPERATING LICENSE DPR-47 AND AMENDMENT NO. 329 TO RENEWED FACILITY OPERATING LICENSE DPR-55 DUKE ENERGY CORPORATION OCONEE NUCLEAR STATION, UNITS 1, 2, AND 3 DOCKET NOS. 50-269, 50-270, AND 50-287
1.0 INTRODUCTION
By letter dated July 11, 2002, Duke Energy Corporation (the licensee) submitted a request for changes to the Oconee Nuclear Station, Units 1, 2, and 3, Technical Specifications (TS).
The requested changes would make editorial corrections to the following TS and/or surveillance requirements (SR):
1.1 TS 3.3.6.b and associated Bases - delete the phrase and RB Essential Isolation.
1.2 TS SR 3.3.8.3, TS 3.3.18, TS SR 3.4.14.1, TS SR 3.8.1.14, TS 3.8.2, TS SR 3.8.2.1, and TS SR 3.10.1.15 - change NOTE to NOTES, or NOTES to NOTE.
1.3 TS 3.4.11 - correct the misspelled word Termal to Thermal.
1.4 TS 3.8.4 - correct the misspelled word panelboards(s) to panelboard(s).
1.5 TS 5.5.17 - change the a to b for the second item.
2.0 REGULATORY EVALUATION
The proposed amendments are administrative in nature and make editorial corrections; therefore, there are no specific regulatory requirements associated with the proposed amendments.
3.0 TECHNICAL EVALUATION
3.1 TS 3.3.6.b - The licensee has determined that Engineered Safeguards channels 3 and 4 do not serve an isolation function. Therefore, the phrase and RB Essential Isolation should not be in this TS and its removal is a minor editorial change. The staff finds that deletion of this phrase is acceptable.
3.2 TS SR 3.3.8.3, TS 3.3.18, TS 3.8.2, and TS SR 3.8.2.1 contain more than one note; therefore, NOTE was changed to NOTES. TS SR 3.4.14.1, TS SR 3.4.1.14, and TS SR 3.10.1.15 contain only one note; therefore NOTES was changed to NOTE.
The staff finds these changes acceptable.
3.3 The spelling correction in TS 3.4.11 is acceptable.
3.4 The spelling correction in TS 3.8.4 is acceptable.
3.5 Both items in TS 5.5.17 were identified as a. Changing a to b for the second item is acceptable.
4.0 STATE CONSULTATION
In accordance with the Commission's regulations, the South Carolina State official was notified of the proposed issuance of the amendments. The State official had no comments.
5.0 ENVIRONMENTAL CONSIDERATION
Pursuant to 10 CFR 51.22, 51.32, and 51.35, an environment assessment and finding of no significant impact was published in the Federal Register on September 5, 2002 (67 FR 56860),
for this amendment. Accordingly, based upon the environmental assessment, the Commission has determined that issuance of this amendment will not have a significant effect on the quality of the human environment.
6.0 CONCLUSION
The Commission has concluded, based on the considerations discussed above, that: (1) there is reasonable assurance that the health and safety of the public will not be endangered by operation in the proposed manner, (2) such activities will be conducted in compliance with the Commission's regulations, and (3) the issuance of the amendments will not be inimical to the common defense and security or to the health and safety of the public.
