Dear Mr. Mulligan:
I am responding to your e-mails dated July 10, 2002, and July 12, 2002, both of which were addressed to me. Copies of your e-mails are enclosed for completeness, and are also available in the U.S. Nuclear Regulatory Commissions (NRCs) Agencywide Document Access and Management System (ADAMS), under the accession numbers ML022000497 and ML022000509.
In your e-mail dated July 10, 2002, you are correct that the NRC does not respond to all correspondence. I should have said that the NRC responds to all correspondence submitted in accordance with Title 10 of the Code of Federal Regulations (10 CFR), Section 2.206. You also questioned why the NRC does not investigate issues associated with unionization of the work force at nuclear plants. The NRC is a Federal agency operating on authorization from the United States Congress. We are limited to expending resources on issues that are within our jurisdiction. Some of the issues addressed by your e-mails are not within the NRC's jurisdiction.
Unionization issues, for example, are within the jurisdiction of the National Labor Relations Board and the Department of Labor. Those issues that are within the NRC's jurisdiction will continue to be addressed by existing programs designed to accommodate participation by members of the public. As you requested in your e-mail, we will distribute this letter to the same licensees who received copies of the letter dated June 14, 2002.
In your e-mail dated July 12, 2002, you discussed difficulties with the use of ADAMS, the NRCs document management system. ADAMS reliably stores and controls hundreds of thousands of documents for the NRC, but we acknowledge that the interface with ADAMS can be difficult to use. ADAMS is a relatively new system, and based on user feedback the NRC is working on a more user-friendly interface for public access to ADAMS on the Internet. You also commented on the difficulty in locating a specific document, which I had referred to in my letter dated June 27, 2002, as Inspection Report 50-219/200-003, dated December 20, 2000. There were typographical errors in the title, and it was incorrectly classified in ADAMS as non-publicly available. It is Inspection Report 50-219/2000-008. It is dated December 20, 2000, and can be located in ADAMS under the accession number ML003779093. Inspection reports can also be accessed on the NRC web page (www.nrc.gov) by selecting Nuclear Reactors, then Operating Reactors, from the upper bar, then selecting Oversight from a link on the next web page, then Inspection Reports from a link on the following web page. This inspection report was available to the public from the NRC web page even though it was not previously available to the public in ADAMS (that has been corrected). I apologize for the error.
