Committed to Nudear Exce!ft?nce Nuclear Manaaement Company, LLC February 7,2007 L-HU-07-004 10 CFR 50.75 10 CFR 50.54 U.S. Nuclear Regulatory Commission ATTN: Document Control Desk Washington, DC 20555 Palisades Nuclear Plant Docket 50-255 License No. DPR-20 Withdrawal of lrradiated Fuel Manaqement Plan and Preliminaw Decommissioninn Cost Estimates for Palisades Nuclear Plant By letter dated April 21, 2006, as supplemented by letter October 10, 2006, Nuclear Management Company, LLC (NMC) requested Nuclear Regulatory Commission (NRC) reviiew and approval of the lrradiated Fuel Management Plan and the Preliminary Decommissioning Cost Estimate for the Palisades Nuclear Plant (PNP).

These submittals were made in accordance with the requirements contained in 10 CFR 50.54(bb) and 10 CFR 50.75(f)(2). 10 CFR 50.54(bb), "Conditions of licenses" states, a licensee shall "submit written notification to the Commission for its review and preliminary approval of the program by which the licensee intends to manage and provide funding for the management of all irradiated fuel at the reactor following permanent cessation of operation of the reactor until title to the irradiated fuel and possession of the fuel is transferred to the Secretary of Energy for its ultimate disposal in a repository." Additionally, 10 CFR 50.75(f)(2),

"Reporting and recordkeeping for decommissioning planning" states, "each power reactor licensee shall at or about 5 years prior to the projected end of operations submit a preliminary decommissioning cost estimate which includes an up-to-date assessment of the major factors that could affect the cost to decommission."

Subsequently, on January 17, 2007, NRC renewed PNP's Facility Operating License for an additional 20-year period; therefore, the requirement for NRC review and approval of these reports at this time no longer exists. Based on the above, NMC is withdrawing the request for review and approval of the lrradiated Fuel Management Plan and the Preliminary Decommissioning Cost Estimate for PNP.
