& 10 CFR 2.390 U. S. Nuclear Regulatory Commission Attn: Document Control Desk Washington, DC 20555 RE: Turkey Point Units 3 and 4 Docket Nos. 50-250 and 50-251 Proposed License Amendment Reactor Trip System Technical Specifications Changes Pursuant to 10 CFR 50.90, Florida Power & Light Company (FPL) requests to amend Facility Operating Licenses DPR-31 and DPR41 for Turkey Point Units 3 and 4. The proposed amendments revise the Technical Specifications (TS) for several Reactor Protection System functional units as described below:

  • The value of the P-8 interlock setpoint is being changed from 45% rated thermal power (RTP) to 40% RTP. The value of the P-8 interlock allowable value is being changed from 48% RTP to 43% RTP.

Enclosure 1 provides a description of the proposed License Amendments together with thejustifications for the proposed changes. Enclosure 2 is the No Significant Hazards Considerations and Enclosure 3 provides the Environmental Consideration. FPL has determined that the proposed License Amendments do not involve a significant hazards consideration pursuant to 10 CFR 50.92. Enclosure 4 provides the marked-up copies of the proposed Technical Specification changes, and an information copy of the proposed changes to the TS Bases.

Enclosure 5 is a copy of the retyped TS pages, and an information copy of the retyped TS Bases pages. There are no new regulatory commitments associated with this request for these TS amendments.

The Turkey Point Plant Nuclear Safety Committee and the Florida Power & Light Company Nuclear Review Board have reviewed the proposed amendments. In accordance with 10 CFR 50.91 (b)(1), a copy of the proposed amendments is being forwarded to the State Designee for the State of Florida.

The proposed license amendments associated with deleting the steam/feedwater flow mismatch coincident with steam generator water level - low reactor trip are similar to other NRC approved industry license amendments, in particular the Beaver Valley Unit 1 License Amendment No. 240, approved August 8,2001. The proposed license amendments associated with changing the reactor trip on turbine trip interlock from P-7 to P-8 are similar to other NRC approved industry license amendments, in particular the Indian Point Unit 3 License Amendment No. 192, approved September 8, 1999.

§10 CFR 50.90 Page 2 of 4 Turkey Point Units 3 and 4 Docket Nos. 50-250 and 50-251 Proposed License Amendments Reactor Trip System Technical Specifications Changes FPL plans to implement these changes at the start of Cycle 22 for Unit 3 (Spring 2006), and at the start of Cycle 23 for Unit 4 (Fall 2006). In order to meet this implementation plan, FPL requests that the proposed License Amendments be approved by March 1,2006. Please issue the amendments to be effective on the date of issuance and to be implemented within 60 days of receipt by FPL. consists of Enclosures lA through ID. Enclosure lA, "Licensing Input for Deletion of Steam/

Feedwater Flow Mismatch Reactor Trip," and Enclosure iC, "Licensing Input for RPS Modifications Changing Reactor Trip on Turbine Trip Permissive from P-7 to P-8," contain information that is proprietary to Westinghouse Electric Company. Enclosure lB and Enclosure ID contain the non-proprietary versions of Enclosures IA and IC, respectively.

The proprietary information in each of the Enclosures IA and IC is supported by an affidavit signed by Westinghouse, the owner of the proprietary information. Each affidavit sets forth the basis on which the information may be withheld from public disclosure by the Commission and addresses with specificity the considerations listed in paragraph (b) (4) of Section 2.390 of the Commission's regulations. Enclosure 6 contains the Westinghouse authorization letter, CAW-05-1958, accompanying affidavit, Proprietary Information Notice, and Copyright Notice for Enclosure IA, and Enclosure 7, CAW-05-1959, contains the same information related to Enclosure IC.

Accordingly, it is respectfully requested that the information which is proprietary to Westinghouse be withheld from public disclosure in accordance with 10 CFR Section 2.390 of the Commission's regulations.
