regarding proposed changes to the Technical Specifications and to the Operating License to relo ute Technica! Specification requirements for Fire Protection to an AdnJ iistrative Procedure (JPTS-93-020).
Dear Sir:
The Authority is revising an application for an amendment to the James A. FitzPatrick Operating License and to the Technical Specifications. The original application (Reference) added the NRC's standard fire protectica license condition to the Operating License, and relocated fire protection requirements from the Techr'ical Specifications to an administrative procedure.
The first change to the application completes the list of Safety Evaluations and exemptions in the license condition. Several NRC safety evaluations were not included in the July 21,1994 submittal. The second change updates the draft copy of AP-01.04 Tech Spec Related Requirements, Lists and Tables included with the application to reflect Technical Specification Amendment 214. Amendment 214 deleted a reference to a superseded ASTM standard for diesel fuel oil.
The first change adds several references to the Technical Specification Amendments that comprise the fire protection requirements and to include references to the fire protection exemptions in the proposed Operating License change. The Authority's original submittal did not list Safety Evaluations associated with Technical Specification changes or exemptions.
The second change updates the draft administrative procedure included with the application. Issuance of Technical Specification Amendment 214 was not reflected in the draft of AP-01.04 which deleted a reference to superseded standard ASTM D 270-65. This standard affected surveillance testing of the diesel fire pump fuel oil.

Four pages are being revised. Revised pages have vertical lines in the margins marking where changes have been made. Attachment 1 is instructions for incoporating these changes in the application. Attachment 2 are the replacement pages. Three of the revised pages affect the Operating License or the associated s&fety evaluation. The remaining page affects draft AP-01.04.
A copy of this application and the associated attachments are being provided to the designated New York State official in accordance with 10 CFR 50.91.
