The New York Power Authority has completed many improvements to the FitzPatrick Fire Protection Program. This letter documents the completion of "short term actions" and

" prior to startup items" committed to by the Authority over the past year. This letter also describes why the Authority no longer requires two temporary exemptions from the requirements of 10 CFR 50, Appendix R.

Short Term Actions The Authority committed to complete nine short term fire protection actions prior to -

startup from the current refueling outage (Reference 1). These short term actions were also identified in the Section 2.2.1 of NRC Inspection Report 92-80 (Reference 2). These actions have been completed and are listed in Attachment 1.

Based on discussions with the NRC Inspection Team leader, the NRC reviewed and closed these short term actions during recent inspection 92-14. The closure statas of these actions is included as Attachment 2, item 92-80-02E.

Prior to Startup Items The Authority committed to complete forty five fire protection items prior to startup from the current refueling outage (Reference 6). Except for the five item.s still under NRC review and four items that will be submitted prior to startup, these items have been completed.

Review and closure of these items during NRC Inspection 92-14 is identified in Attachment 2 as JPF w023 items.

Appendix R Exemption Requests The Authority requested and was granted two temporary exemptions from the requirements of Section Ill.G.3 of Appendix R to 10 CFR 50 (References 3,4, and 5). These exemptions gave the Authority temporary relief from the Appendix R requirements for a fixed suppression system in the batiery room corridor and a fire detection system in the area north of the Electric Bays in the Turbine Building. The modifications associated with short term actions 4 and 9 have been completed. Therefore, these exemptions are no longer necessary.

Attachment 1 to JPN-92-073 Completed Fire Protection Short Term Actions

1. Modify (or replace, as appropriate) the following 19 fire dampers: 67FD-4, 67FD 5, 67FD-13, 67FD-18, 67FD-26, 67FD-35, 70FD-3, 70FD-4, 70FD-5, 70FD-6, 70FD 7, 70FD 10, 72FD-12, 73FD-1 A, 73FD-1 B, 73FD-10, 73FD-1 D, 73FD-1 E and 73FD-1 F.
2. Complete the evaluation of installed fire door closure and gaps, and implement modifications to correct deficiencies.
3. Complete the evaluation to determine fire protection adequacy of exposed structural steel in the Battery Charger Rooms. Complete any necessary modifications.
4. Install a suppression system in the Battery Room Corridor (Fire Area XVl/ Fire Zone BR-5).
5. Complete the evaluatior, of the Control Room / Relay Raom ventilation (Fire Area Vil/ Fire Zones CR-1 and RR-1). Complete any necessary modifications.
6. Resolve audit findings on NFPA code compliance and design reviews.
7. Assure compliance with modification procedures for fire protection evaluations.
8. Complete the review of twenty randomly selected, previously installed modifications for fire protection and Appendix R concems. Resolve any identified concems.
9. Install fire detection in Fire Area IE/ Fire Zone TB-1, north of the Electric Bays.
