BRAIDWOOD GENERATING STATION - SECURITY BASELINE INSPECTION REPORT 05000456/2022420 AND 05000457/2022420 - REISSUED
Dear David Rhoades:
On September 22, 2022, the U.S. Nuclear Regulatory Commission (NRC) completed an inspection at Braidwood Station and discussed the results of this inspection with Gregory Gugle and other members of your staff. On October 24, 2022, NRC issued inspection report 05000456/2022420 and 05000457/2022420 which contained one non-cited violation (NCV)
(Agencywide Documents Access and Management System [ADAMS] Accession No.
ML22293B798). On November 18, 2022, you provided a response to the inspection report and disagreed with NCV 05000456,05000457/2022420-01 (ML22325A023). On December 12, 2022, the NRC acknowledged receipt of your response (ML22346A036) and informed you that we would evaluate your response and provide the results of our evaluation. On February 6, 2023, the NRC provided the results of the disputed NCV evaluation (ML23012A080).
After consideration of the available information, the NRC has concluded that the NCV is upheld; however, the NRC acknowledges that the original NCV contained insufficient basis to support the NRC conclusions. Therefore, the NRC has revised the NCV to contain the relevant basis information to support the determination of a performance deficiency and violation of regulatory requirements and reissued the report.
This letter will be made available for public inspection and copying at http://www.nrc.gov/reading-rm/adams.html and at the NRC Public Document Room in accordance with Title 10 of the Code of Federal Regulations Section 2.390, Public Inspections, Exemptions, Requests for Withholding. March 22, 2023 The enclosed report contains Security-Related Information, so the enclosed report will not be made publicly available in accordance with Title 10 of the Code of Federal Regulations (10 CFR) 2.390(d)(1). If you choose to provide a response that contains Security-Related Information, please mark your entire response Security-Related Information-Withhold from public disclosure under 10 CFR 2.390 in accordance with 10 CFR 2.390(d)(1) and follow the instructions for withholding in 10 CFR 2.390(b)(1). The NRC is waiving the affidavit requirements for your response in accordance with 10 CFR 2.390(b)(1)(ii).
