Dear Mr. Fitzpatrick:
SUBJECT: NOTICE OF VIOLATION (NRC INSPECTION REPORT NO. 50-315/91012; 50-316/91012(DRS)) This will acknowledge receipt of your letter dated July 24, 1991, in. response to our letter dated June 24, 1991, transmitting a Notice of Violation associated with Inspection Report No. 50-315/91012 50-316/91012.
Your letter contested the violation by differentiating between "verification" and "inspection" activities, and by claiming that only "inspection" activities were covered under your quality assurance program description section 1.7.10.2.4.
However, you did acknowledge a weakness in your program in regard to documentation of the necessary qualifications for independent verification activities.
Your position was conveyed to the ~ Region during a telephone conversation on July 15, 1991, between Mr. K. Baker, and others of your staff, and Mr. G. Wright and other NRC staff members.
We have concluded that "inspection" and "verification" activities are not necessarily the same.
Based on this, we agree with your contention that section 1.7.10.2.4 of your quality assurance program did not apply to the activities witnessed by our inspectors.
Therefore we are withdrawing the violation.
