NRC INSPECT'ON REPORT 50-298/96-24 AND 96 31, NOTICE OF VIOLATION AND EXERCISE OF ENFORCEMENT DISCRETION l

Dear Mr. Horn:

Thank you for your letter of July 24,1997, in response to our letter and Notice of

'

Violation dated June 25,1997. Our letter addressed eight examples of a failure to update the Updated Safety Analysis Report as required by 10 CFR 50.71(e) (Violation A) and three examples of a failure to perform adequate written safety evaluations in accordance with 10 CFR 50.59 (Violation B). We have reviewed your reply to Violation A and find it responsive to the concerns raised in our Notice of Violation. We will review the implemente.t;un of your corrective actions during a future inspection to determine that full compliance has been achieved and wi:1 be maintained.

Regarding Violation B, we noted that while you admitted to all of the violation examples, you believe that Example 1 of Violation B should have been characterized as a violation of 10 CFR 50.71(e) in lieu of 10 CFR 50.59(b)(1). As discussed in NRC Inspection Report 50-298/96-31, Procedure 0.7.1, " Control of Combustibles," allowed up to 90 pounds of combustibles in the service water booster pump room. This procedure contradicted Updated Safety Analysis Report Section X.8.2.8.C. " Common Mode Failure Analysis -

Fire," which specified that no combustibles be located in the service water booster pump room area since both trains of service water were located in close proximity. The presence of up to 90 pounds of combustibles in the service water booster pump room constituted a change to a procedure as described in the Updated Safety Analysis Report. Therefore, a written safety evaluation should have been performed as required by 10 CFR 50.59 (b)(1).

Nonetheless, we consider your corrective actions for all the examples of Violation B to be responsive to the concerns raised in our Notice of Violation. We will review the implementation of your corrective actions during a future inspection to determine that iu!I compliance has been achieved and will be maintained.
