NRC INSPECTION REPORT NOS. 50-269/94-21, 50-270/94-21 AND 50-287/94-21 This refers to the special inspection at your Oconee facility conducted by P. E. Harmon of this office on June 15 through July 16, 1994. The inspection involved a review of the circumstances surrounding the inadvertent lockout of the Keowee overhead emergency power path on June 14, 1994. At the conclusion of the inspection, the findings were discussed with those members of your staff identified in the enclosed inspection report (Enclosure 1).
Areas examined during the inspection are identified in the report. Within these areas, the inspection consisted of selective examinations of procedures and representative records, interviews with personnel, and observation of activities in progres Based on the results of this inspection, an apparent violation was identified and is being considered for escalated enforcement action in accordance with the "General Statement of Policy and Procedure for NRC Enforcement Actions" (Enforcement Policy), 10 CFR 2, Appendix C. The apparent violation involves a single failure vulnerability for the Keowee Units that existed from initial construction until the completion of a modification on June 23, 199 Specifically, a loss of all or portions of a non-seismically qualified, nonsafety-related air system could have resulted in an automatic lockout of the emergency overhead power path. This, combined with a single failure that would cause a loss of the emergency underground path, would have resulted in a complete loss of on-site emergency power. This design was contrary to the design requirement that the on-site Emergency Power System be capable of meeting all design basis requirements while assuming a worst case single failure. Additionally, this design was such that a fault on an underground path breaker would result in a lockout of the overhead path, which violated the requirement for the overhead and underground paths to be independen Accordingly, no Notice of Violation is presently being issued for this inspection finding. The decision to hold an enforcement conference does not mean that the NRC has determined that a violation has occurred or that enforcement action will be taken. The purposes of this conference are to discuss the apparent violation, its cause and safety significance; to provide you the opportunity to point out any errors in the inspection report; and to provide an opportunity for you to present your proposed corrective action(s). In particular, we expect you to address: 1) the timeliness of your operability determinations and corrective actions associated with the June 14, 1994 lockout event; 2) the basis for the initial modification which incorporated the automatic lockout on low Air Circuit Breaker air pressure; 3) the failure of the previous programmatic efforts completed in January 1993, to identify and correct this single failure vulnerability; 4) the adequacy of the maintenance and testing of this system; and 5) the operators knowledge of the design and operation of this system. In addition, this is an opportunity for you to provide any information concerning your perspectives on 1) the severity of the violation, 2) the application of the factors that the NRC considers when it determines the amount of a civil penalty that may be assessed in accordance with Section VI.B.2 of the Enforcement Policy, and 3) any other application of the Enforcement Policy to this case, including the exercise of discretion in accordance with Section VI You will be advised by separate correspondence of the results of our deliberations on this matter.
