EXERCISE OF ENFORCEHENT DISCRETION (NRC INTEGRATED INSPECTION REPORT NOS. 50-250/98-07 AND 50-251/98-07)
Dear Nr. Plunkett:
On July ll, 1998, the Nuclear Regulatory Commission (NRC) completed an inspection at Florida Power and Light Company's (FPL) Turkey Point facility.
The results of that inspection were.discussed at an exit meeting conducted on July 14.
1998, and documented in NRC Inspection Report Nos. 50-250/98-07 and 50-251/98-07, issued on August 10, 1998.
During the inspection, the NRC examined an issue, identified by FPL in 1998, associated with a 1984 modification which affected residual heat removal (RHR)
system pressure control relays.
Specifically, the 1984 modification failed to adequately separate non-safety and safety-related electrical loads, and resulted in a potential for loss of power to the B train RHR motor operated valves (HOVs) for both units.
These valves are required for the piggy-back mode of RHR during a loss of coolant accident.
This design deficiency could potentially prevent operation of these valves, because a fai lure in a non-safety-related portion of the electrical circuit could result in loss of power to the MOVs.
FPL determined that the A train RHR HOVs were unaffected.
FPL reported this condition to the NRC as outside the design basis of the plant in Licensee Event Report (LER) 50-250/98-002-00, dated June 6, 1998.
Based on the information developed during the inspection, the NRC has determined that this issue constitutes a violation of regulatory requirements.
CFR 50, Appendix B. Criterion III, Design Control, requi res that measures shall be established to assure that the design basis of safety-related systems is correctly translated into specifications, drawings, procedures and instructions.
In this case, the requirements of 10 CFR 50, Appendix B, Criterion III, were not met in that the 1984 modification of the B train RHR motor operated valves did not correctly translate the design basis of the plant into specifications and instructions.
A violation involving a safety-related system which is unable to perform its intended safety function under certain conditions is generally characterized as a Severity Level III violation in accordance with the "General Statement of Policy and Procedures for Enforcement Actions" (Enforcement Policy),
However, as provided in Section VII.B.3 of the Enforcement Policy, the NRC may refrain 9808200234 980814 PDR ADQCK OS000250 POR
FPL from issuing a Notice of Violation (Notice) and proposing a civi 1 penalty for a Severity Level III violation which involves old design issues.
After review of this violation and consultation with the Directors'ffice of Enforcement, the NRC has concluded that while a violation did occur, enforcement discretion is warranted and issuance of a Notice is not appropriate in this case.
The specific bases for the decision to exercise enforcement discretion are:
(j.) FPL identified the deficiency through a
self-initiated audit of instrument busses:
(2) actions were promptly completed to provide power for the affected relays from properly protected
., safety-related power supplies; (3) the issue was not likely to have been
=.;identified by routine surveillance or quality assurance reviews:
(4) the pressure relay power supply issue is considered an old design issue in that an error was made during design of a modification in 1984, and there had been no prior notice such that FPL could have reasonably identified the violation earlier; and, (5) the issue was reported to the NRC in LER 50-250/98-002-00 dated June 6.
