Thank you for your letter of January 28, 1991, in response to our letter and attached Notice of Violation both dated December 24, 1990. We have reviewed your reply and find that you have not fully responded to each of the three items identified on Page 2 of the Notice.
We are pleased to note that you have implemented corrective actions for each of the three violations, however, you did not address measures which will be

taken to prevent the recurrence of these and similar violations.
Therefore, in accordance with the instructions provided in the Notice, you are requested to describe the measures taken to prevent future recurrence of these and similar violations.
-Your reply should be provided to the NRC Region IV office within 10 days of the receipt of this letter.

This refers to the routine, unannounced radiation safety inspection conducted by Mr. Richard A. Leonardi, Jr. of this of fice on November 26, 1990, involving the use of subsurf ace trator material on a wellsite near Fox, Oklahoma, under
,
reciprocity with Byproduct License No. LO3549 issued by the state of Texas and i
to the discussion of cur findings held by the inspector with members of your staf f at the conclusior, of the inspection.
Additionally, the inspection findings wers discussed with Mr. Robinson by way of a telephonic exit interview.
The inspection was an examination of the. activities conducted under the general license as authorized under reciprocity a00 as they re! ate to radiation safety and compliance with the rules and regulations and the conditions of the appropriate spe.cific license.
The insocction consisted of selective examinations of procedures and represeritative records, interviews of personnel and observations by the inspector.
During this inspection, certain of your activities were found not to ce conducted in ful'i compliance with NRC reouirements.
Consequently, you are required to respond to this matter in writing, in accordance with the provisions of Section 2.201 of the NRC's " Rules of Fractice," Part 2, Title 10.

Your respor.se should be based on the specifics contained in the Notice of Violation er:losed with this letter.
In accordence with 10 CFR 2.790 of the Commission's regulations, a copy of this letsec, the enclosure, and your response to this letter will be placed in the NRC Puolic Document Room.

During an NRC inspection conducted on November 26, 1990, violations of NRC l
requirements were identified.
In accordance with the " General Statement of I
Policy and Procedure for NRC Enforcement Actions," 10 CFR Part 2',
Appendix C (1990), the violations are listed below:
10 CFR 150.20(b) requires, in part, that any person engaging in activities in l
non-Agreement States under the general license provided in Section 150.20 sna'.1 l.
comply with all terms and conditions of the specific license issued by an Agreement State.
L Texas Radioactive Material License No. LO3549, License Condition 17 requires, l~
in part, that the licensee shall possest and use radioactive material l
authorized by this license in accordance with statements, representations, and

procedures contained in the Texas Regulati_ons for Control of Radiation (TRCRI.

TRCR Part 36.403 requires, in part, that each licensee conducting well servicing operations at'a temporary job site shall have the following records available at that site for inspection by the Agency:
(1) operating and emergency procedures, and (2) when operating in the State under reciprocity pursuant to 41.90 or 42.10, a copy of the appropriate license, l
Contrary to the above, a copy of the Texas License No. LO3549 ano a copy

of the operating and emergency procedures were not available at the time of the inspection.
This is a Severity Level IV violation.

49 CFR 172.310 requires, in part, that each package of radioactive material which conforms to the requirements for Type A or Type B packaging must he plainly and durably marked on the outside of the package in letters at least 1/2-inch high with the words "Typt A" or
" Type B" as appropriate.
Contrary to the above, the transport container being used by the licensee at the time of the inspection to transport licensed quantities of radioactive material.not exceeding Type A quanti'.ies was not labeled as " Type A" as required.
This is a Severity Level IV violation.

Pursuant to the provisions of 10 CFR 2.201, Robco Production Logging, Inc.., is hereby required to submit to this of fice, within 30 days of the date of the letter transmitting this Notice, a written statement or explanation in reply, including'for each violation:
