H.y The' instructions' in this guide , in conjunction .with T4 le 1, specify the radionuclides and radiation exposure rate limits which should be used in decontamination and survey of surfaces or premises and equipment-prior to abandonment or release for unrestricted use. The limits in Table 1 ,

do not apply to premises, equipment, or scrap containing induced radio-activity for which the radiological considerations pertinent to their use'may be different.

The release of such facilities or items from regulatory control is considered on a case-by-case basis.

The licensee shall make a reasonable effort to eliminate residual contamination.

Radioactivity on equipment or surfaces .shall-not be covered by paint, plating, or other covering material unless contamination '

. levels, as detemined by a survey and documented, are below the limits specified in Table 1 prior to the application of the covering. A reasonable effort must be made to minimize the -

contamination prior to use of any covering. .

3. The radioactivity on the interior surfaces of pipes drain lines, or ductwork.shall be detemined by making measuremen,ts at all traps, and other appropriate access points, provided that contam-ination at these locations is likely to be representative of

~ contamination on,the interior of the. pipes, drain lines, or' .

ductwork. Suitaces of premises, equipment or scrap which are likely to be contaminated but are of such size, construction, or location as to make the surface inaccessible for purposes of measurement ~ shall be presumed to be contaminated in excess of .

the limits. -

4. Upon request, the Consission may authorize a licensee to relinquish possession or control of premises - equipment, or scrap having l surfaces contaminated with materials in-excess of the limits.specified. '

This may include,' but sould not be limited to, special circiastances such as razing of buildings, transfeFof premises to another organization continuing work with radioactive' materials, or conversion of facilities to a long-tens storage or standby status. Such requests must:

a. Provide detailed, specific information describing the premises, -

equipment or scrap, radioactive contaminants, and the nature, extent, and degree of residual surface contamination.

b. provide a detailed health and safety analysis which reflects that the residual amounts of materials on surface areas, together with other. considerations such as prospective use of
  • t the premises, equipment or scrap, are unlikely to result in an unreasonable risk to the health and safety of the public.

5. Prior to release of premises for unrestricted use, the licensee shall make a comprehensive radiation survey which establishes that contamination is within the limits specified in Table 1. A copy of the survey report shall be filed with the Division of Fuel Cycle and Material Safety, USNRC, Washington, D.C. 20555, and also the ,

Administrator of the NRC Regional Office having jurisdiction. The  !

report should be filed at least 30_ days prior to the planned date of abandonment. The survey report shall:

a. Identify the premises.
b. Show that reasonable effort has been made to eliminate "

i residual contamination.

c. Describe the scope of .the survey ar.d general procedures followed.
d. State the findings of the survey in units specified in the instruction. ,

Following review of the report, the NRC will consider visiting the facilities to confirm the survey.

Dear Mr. Flary:

The enclosed laboratory analysis of a soil sample frm the subject facility was received by this office on Septenber 11, 1985. The sample was obtained from the ground surface within the perimeter fence on the west side of the' plant on March 28, 1985. Mr. Wilson of Dollar Savings Association was pre-sent during the sampling and has been advised of the results. The analysis indicates elevated levels of cadmium present in the soil.

The sampling was conducted pursuant to the Pennsylvania Solid Waste Management Act, the Act of July 7,1980, P.L. 380, No. 97, 35 P.S. 6018.101 et ~

_seg. The requirements of this Act are being enforced by the Pennsylvania Department of Environmental Resources, which has also received interim authori-zation fran the United States Environmental Protection Agency to conduct a hazardous waste management program which ocmplies with the Federal Standards on EPA's behalf within the Commonwealth of Pennsylvania.

The cadmim contamination is in violation of the Pennsylvania Solid Waste Management Act, Act 97, the Act of July 1980, P.L. 380, (No. 97), 35 P.S.

Section 6018.101 et seq. It is believed that the soil contamination may have occurred during close-out operations at the plant site in the spring of 1983.

It is the Department's understanding that although the plant was operated by Metcoa, the plant property is owned by the Lawrence Cbunty Industrial Develornent Agency.

Section 610 of the Act states that it shall be unlawful for any person or municipality to:

(1) Dunp or deposit, or permit the dtnping or depositing, of any solid waste onto the surface of the ground or underground or into the waters of the Camonwealth, by any neans, unless a permit for the dumping of such solid wastes has been obtained frcan the departnent...

(4) Store, wilect, transport, process, trea , or dispose of, or assi::t in the storcge, collection, transportation, processing, treatment, er l disposal of, solid waste contrary to the rules or regulatalons adcpted under l this act, or orders of the department, or any term or any condition of any per-

! mit, or in any manner as to create a public nuisance or to adversely affect the public health, safety and welfare.

(9) cause or assist in the violation of any provision of this act, any nale or regulation of the department, any order of the department or any term or condition of any permit.

In order to abate the violations, you are hereby requested to prepare and submit to the Department for review and approval a report which will include l

1. An assessment of the extent of soil contamination.
2. Provisions for the removal of contaminated soil to an approved disposal facility.
3. Provisions for the restoration of the ground surface and erosion control measures. .
4. A schedule of laplementation. Said report should be submitted to no later than 120 days after receipt of this notice. Failure to submit the Department the report as requested may result in further legal action.

This letter does not waive, either expressly or by implication, the power or authority of the Ccamonwealth of Pennsylvania to prosecute for any and all violations of law arising prior to or after the issuance of this letter or the conditions upon which the letter was based, nor shall this letter be construed so as to waive or inpair any rights of the Department of Environmental Resources, heretofore or hereafter existing.

This letter shall also not be construed as a final action of the Department of Environmental Resources.
