NPF-63 WITHDRAWAL OF THE RELIEF REQUEST TO USE THE FREQUENCY OF ASME OM CODE CASE OMN-13 FOR THE VISUAL EXAMINATION OF SNUBBERS Ladies and Gentlemen:

By [[letter::HNP-04-006, Request to Use the Frequency of ASME OM Code Case OMN-13 for the Visual Examination of Snubbers|letter dated February 3, 2004]], Carolina Power & Light Company doing business as Progress Energy Carolinas, Inc., requested a relief request for the Shearon Harris Nuclear Power Plant (HNP), Unit 1, Facility Operating License No. NPF-63. The proposed relief request, pursuant to 10 CFR 50.55a(3)(i), would have changed the frequency of snubber visual examinations to the frequency specified in the American Society of Mechanical Engineers (ASME) Operation and Maintenance (OM) Code Case OMN-13 for the remainder of the second 10-year inservice inspection interval. The basis of this request was that the proposed alternative would provide an acceptable level of quality and safety.

In a telephone call on March 23, 2004, it was determined that a Technical Specification (TS) amendment referencing the ASME OM Code would be more appropriate than the relief request. By letters dated May 5, 2004 and August 6, 2004, HNP has submitted and clarified a request for a TS amendment referencing the ASME OM Code. Since the ASME OM Code has been referenced in a request for a TS amendment, the above cited relief request is no longer applicable. Therefore, HNP requests withdrawal of the relief request.
