DATE OF DISCOVERY

The event described in this report occurred on April 15, 2003.

IDENTIFICATION OF OCCURRENCE

At 4:50 A.M., two on-watch security officers were found to be asleep.

Operating License condition 2.C.(4) requires:

"The licensee shall fully implement and maintain in effect all provision of the Commission approved physical security, guard training and qualification, and safeguards contingency plans...

By order dated February 25, 2002, the license was modified to require manning the Inner OCA security checkpoint. This occurrence was a violation of that order. Operating License condition 2.E requires:

"...the licensee shall report any violations of the requirements contained in Section 2.0 of this license...(by an) initial notification...within 24 hours2.777778e-4 days <br />0.00667 hours <br />3.968254e-5 weeks <br />9.132e-6 months <br /> to the NRC Operations Control Center via the Emergency Notification System with written follow-up within 30 days...

CONDITIONS PRIOR TO DISCOVERY

At the time of the occurrence, the reactor was at 100% power with all temperatures and pressures normal for full power operation.

DESCRIPTION OF OCCURRENCE

At approximately 4:50 A.M., the Oyster Creek Operations Director arrived at the station and was appropriately processed by the Outer Owner Controlled Area (OCA) checkpoint. He proceeded to the Inner OCA checkpoint where he noticed that the security guards did not immediately exit the guardhouse to verify his identification and check his vehicle. He proceeded to the Guard House where he observed the guards, apparently asleep. Notifications were made both to AmerGen Energy Company, LLC personnel, and the USNRC Emergency Notification System Line.

APPARENT CAUSE

The apparent cause of the license violation was the inattention of the of the security officers to their assigned duties.

ANALYSIS OF OCCURRENCE AND SAFETY ASSESSMENT

The guards were observed to be attentive to duty at 4:20 A.M. by a Security Supervisor during his normal rounds, and they responded to a radio check at 4:30 A.M. Therefore, the condition could not have existed for more than approximately 20 minutes. Upon discovery, an immediate search of the Inner OCA was conducted to ensure that no unauthorized vehicles had entered. The Inner OCA checkpoint is monitored by a surveillance camera. Review of the videotape revealed that no vehicles entered the Inner OCA during this 20-minute period. This information was corroborated by an interview with the Outer OCA guard. This occurrence did not involve a potential breech of the protected area or the vital areas of the plant.

A review of time records revealed that both guards were in compliance with corporate overtime limitations.

CORRECTIVE ACTIONS

Immediate Actions

1. Both guards were relieved from all duties. Two new guards manned the Inner OCA post.

2. Both guards were "For Cause" Fitness for Duty tested. All readings were negative.

3. All required NRC and Exelon notifications were made.

4. Security reinforced management expectations to all Security Personnel on attentiveness to duty.

Short Term 1. Fitness for Duty training for Security supervisors was reviewed to ensure that fatigue and/or drowsiness is routinely assessed.

2. The frequency of remote post checks was increased.

3. A Corrective Action Program document was issued to track the resolution of these issues.

Long Term 1. The Security Contractor was notified of changes to procedures and processes to prevent recurrence.
