Items of Interest Week Ending June 24, 2022 The U.S. Nuclear Regulatory Commission (NRC) Held a Public Meeting on Title 10 of the Code of Federal Regulations (10 CFR) Part 53 Framework B On June 16, 2022, the NRC staff held a public meeting on 10 CFR Part 53 Framework B, a technology-inclusive alternative licensing framework for new commercial nuclear plants where risk insights are used in a supporting manner, similar to the established licensing frameworks in 10 CFR Parts 50 and 52. The NRC staff summarized Framework B preliminary proposed rule language and discussed a key feature of Framework B, an Alternative Evaluation for Risk Insights (AERI). AERI is a first-of-a-kind, optional alternative to a probabilistic risk assessment for designs where the projected consequences of potential accidents are very small. The NRC staff issued preliminary proposed rule language for Framework B, a Framework B development process and provisions summary white paper, and two pre-decisional draft regulatory guides associated with AERI in the Agencywide Document Access Management System under Accession Numbers ML22145A000, ML22160A039, ML22146A045, and ML22146A041 respectively, to support the public meeting.

NRC held a Public Meeting to Discuss Planned Rulemaking On June 22, 2022, the NRR and the Office of Nuclear Material Safety and Safeguards staff held a hybrid, comment-gathering public meeting to discuss the planned rulemaking detailed in SECY-21-0109, Rulemaking Plan on Use of Increased Enrichment of Conventional and Accident Tolerant Fuel Designs for Light-Water Reactors" (ML21232A237), and Staff Requirements Memorandum SECY-21-0109 (ML22075A103). The NRC staff presented on the rulemaking process, the status, and path forward for the Increased Enrichment Rulemaking (ML22153A451). The Nuclear Energy Institute also presented on the Industry Perspectives on Rulemaking for Greater than 5% Enrichment (ML22172A135). Finally, the NRC staff facilitated a discussion with stakeholders on the scope of regulations and guidance documents that should be evaluated in this rulemaking effort. There were over 100 NRC, industry, and public attendees.

Office of Nuclear Material Safety and Safeguards (NMSS)

Items of Interest Week Ending June 24, 2022 NMSS Staff Hosted a Public Meeting on Reporting Requirements for Low Enriched Uranium On June 22, 2022, the NRC hosted a public meeting to discuss foreign obligation reporting requirements for low enriched uranium (LEU). The participants included stakeholders who report to the Nuclear Materials Management and Safeguards System (NMMSS) as well as federal representatives from the U.S. Government interagency who are responsible for implementation of nuclear cooperation agreements, also known as Section 123 Agreements.

The fuel cycle industry has expressed interest in ensuring that tracking and reporting obligations on LEU of different enrichment levels does not become an impediment to blending operations needed to produce commercial LEU fuel enriched to greater than 5 weight percent. The meeting focused on providing background on the requirements to report foreign obligations to NMMSS, receiving industrys questions related to reporting obligations on LEU, and obtaining input on possible ways to facilitate foreign obligation exchanges involving LEU while maintaining adequate obligation tracking and reporting.

NMSS Staff Conducted Onsite Observation Visit at Idaho National Laboratory On June 22, 2022, members of the NMSS staff conducted an onsite observation visit (OOV) associated with the Idaho Nuclear Technology and Engineering Center (INTEC) Tank Farm Facility (TFF) at the Idaho National Laboratory to get the status of closure of the remaining 4 of 11 high-level waste tanks at the INTEC TFF. Each NRC OOV is conducted in accordance with Section 3116(b) of the Ronald W. Reagan National Defense Authorization Act for Fiscal Year 2005 (NDAA), which requires the NRC to monitor, in coordination with the NDAA-covered State, certain disposal actions taken by the Department of Energy (DOE) for the purpose of assessing compliance with the performance objectives set out in 10 CFR Part 61, Subpart C. In addition, representatives of the Idaho Department of Environmental Quality participated in this OOV. A summary of the OOV will be issued to the DOE within 30 days.

Revision of Fee Schedules; Fee Recovery for Fiscal Year 2022: Final Rule; 10 CFR Parts 170 and 171 [NRC-2020-0031; RIN 3150-AK44]

On June 22, 2022, the NRC published a notice in the Federal Register (87 FR 37197) amending the licensing, inspection, special project, and annual fees charged to its applicants and licensees. These amendments are necessary to implement the Nuclear Energy Innovation and Modernization Act, which requires the NRC to recover, to the maximum extent practicable, approximately 100 percent of its annual budget less certain amounts excluded from this fee-recovery requirement. This final rule is effective on August 22, 2022.
