UNIVERSITY OF UTAH LICENSE RENEWAL AND POWER UPRATE APPLICATION SUBMITTAL- INFORMATION WITHHOLDING REQUIREMENTS

Dear Dr. Slaughter:

The U.S. Nuclear Regulatory Commission (NRC) received your License Renewal and Power Uprate Application dated March 25, 2005. Included in the application was the Safety Analysis Report (SAR). Subsequently, by letter dated July 6, 2006, your staff submitted an update to the SAR which provided for the replacement of Chapters 4 and 13, and Appendices A and C. The information contained in this later submittal was marked "Sensitive Withhold From Public Disclosure Per 10 CFR 2.390" in its entirety.

However, lacking in the July 6, 2006 submittal was information required by Title 10 of the Code of Federal Regulations (10 CFR) 2.390(b) ascertaining the reason the information should be withheld.

Please provide the information required by 10 CFR 2.390(b) including an affidavit and statement of reason why the July 6, 2006, information should be withheld from public disclosure. Please follow the requirements as specified in 10 CFR 2.390. If, after reassessment, you decide that the July 6, 2006, information should not be withheld from public disclosure, please provide a letter indicating so, and a request to retract your July 6, 2006 request to revise the SAR. If the

information provided in the July 6, 2006 submitta l is necessary to update your License Renewal SAR, please provide another copy to the NRC without the "Sensitive Withhold From Public Disclosure Per 10 CFR 2.390" information.
