Docket No. 50-228-LT

ASLBP No. 14-931-01-LT-BD01

August 11, 2014

Memorandum And Order (Denying Aerotest Operations, Inc. and Nuclear Labyrinth, LLC's Motion to File Additional Exhibits)

On August 7, 2014, Aerotest Operations, Inc. and Nuclear Labyrinth, LLC (hereinafter the Companies) submitted a motion seeking to file additional exhibits.

1 On August 8, 2014, the NRC Staff opposed the Companies' motion.

2 Consistent with the rationale in the NRC Staff's opposition, this Board denies the Companies' motion.

3 It is so ORDERED.

THE ATOMIC SAFETY AND LICENSING BOARD

1 See Aerotest Operations, Inc. and Nuclear Labyrinth, LLC's Motion to File Additional Exhibits (Aug. 7, 2014).

2 See NRC Staff's Objection to [the Companies'] Motion to File Additional Exhibits (Aug. 8, 2014). 3 Although it might be argued that the proposed exhibits are probative as to the potential ability of the Department of Energy (DoE) to accept sp ent fuel from particular shut-down nuclear power reactor sites before 2055, they provide no basis for forming a conclusion as to DOE's ability or willingness to accept Aerotest's spent fuel before 2055.
