UNITEDSTATESOFAMERICANULCEARREGULATORYCOMMISIONBEFORETHECOMMISSIONIntheMatterof:))DocketNo.50-255-LA-2ENTERGYNUCLEAROPERATIONS,INC.,))August7,2015(PalisadesNuclearPlant))MOTIONBYSIERRACLUBFORPERMISSIONTOFILEAMICUSBRIEFComesnowtheSierraClub,pursuantto10C.F.R.§2.315,andinsupportofthisMotionforPermissiontoFileAmicusCuriaeBrief,statestotheCommissionasfollows:1.TheSierraClubsupportsthedecisionoftheASLBinthiscasegrantingtheIntervenorsahearingontheircontentionregardingEntergy'slicenseamendmentrequest.2.TheSierraClubisthenation'slargestgrassrootsenvironmentalorganization,withover600,000members.ItsMichiganChapterhasapproximately16,000members.TheSierraClubsupportssustainableenergyalternativesthatdonotharmtheenvironment.TheSierraClubopposesnuclearpowerbecauseitsfuelcyclefromuraniumminingtospentradioactivefuelposesgravedangerstotheenvironment.Inaddition,relianceonnuclearpowerunjustifiablydelaysthebeneficialtransitiontocleanandrenewableenergysources.3.WithspecificreferencetothePalisadesNuclearPlantandtheembrittlementofthereactorvesselatthe plant,membersoftheMichiganChapterareatriskiftheembrittledreactorvesselshattersanddispersesradioactivematerialintotheenvironment.Thiscanaffecttheair,waterandsoiluponwhichMichiganresidentsdepend.Therefore,theattemptbyEntergytoshortcutassurancesthatthereactorpressurevesselissafeposesgraveriskstotheSierraClubanditsmembersintheMichiganChapter.4.TheSierraClub'samicuscuriaebriefisdesirableinthiscasebecauseitwillpresenttheperspectiveofthemanySierraClubmemberswhoareresidentsofMichiganandareaffectedbytheoutcomeofthiscase.Thebriefwillalsoemphasizethefar-reachingimpactsofadecisioninthiscase.AdecisionallowingEntergytoavoidtestingthematerialinthepressurevesselwouldbeabadprecedentforactionsinvolvingembrittlementatotheragingreactors.5.Pursuantto10C.F.R.§2.323(b),undersignedcounselcertifiesthathehascontactedtheotherpartiestothisproceedingaboutthefilingoftheSierraClub'samicuscuriaebrief.TheIntervenorshavenoobjectiontothefilingofthebrief.EntergyNuclearOperationsandtheNRCstaffhavenoobjectiontothefilingoftheamicuscuriaebriefbutreservetherighttorespondtoit.
