22-974-01-LT-BD01 Joint Motion to Extend Deadline for Motion to Strike Pursuant to 10 C.F.R. § 2.323(b), counsel for Applicants1 consulted with counsel for the Michigan Attorney General regarding their intent to file a motion to strike portions of the Attorney Generals Written Responses and accompanying Rebuttal Testimony filed December 16, 2022 (Response and Rebuttal Testimony).2 As a result, the Parties are attempting to reach alignment on the potential withdrawal of certain portions of the Attorney Generals Response and Rebuttal Testimony. The Parties need further time to discuss this matter and potentially resolve the issues without the need for intervention by the Board. Accordingly, the Parties request that the Board extend the deadline for Applicants motion to strike to January 3, 2023.
