CONSIDERATION OF NEW INFORMATION REGARDING POTENTIAL CUMULATIVE IMPACTS FROM THE PROPOSED KAIROS HERMES 2 TEST REACTOR ON THE KAIROS HERMES CONSTRUCTION PERMIT REVIEW On July 14, 2023, Kairos submitted an application for a construction permit (CP) for an additional test facility, referred to as Hermes 2, to be located adjacent to the currently proposed Kairos Hermes test reactor for which the staff has recently completed its final Environmental Impact Statement (EIS) (Agencywide Documents Access and Management System (ADAMS)

ML23214A269. The staff of the U.S. Nuclear Regulatory Commission, Office of Nuclear Material Safety and Safeguards, Division of Rulemaking, Environmental and Financial Support reviewed this new information in relation to the cumulative impacts analysis for the Kairos Hermes test reactor as documented in the final EIS. The staff reviewed the information to determine whether it should be considered new and significant information relevant to the Kairos Hermes test reactor CP application review, in accordance with Title 10 of the Code of Federal Regulations (10 CFR), Section 51.92(a).

The staff followed guidance provided in Staff Process for Determining if a Supplement to an Environmental Impact Statement is Required in Accordance with 10 CFR 51.92(a) or 51.72(a)

(ML120950050), to evaluate and document the significance of this new information. The staff concluded that the new information did not meet either of the criteria in 10 CFR 51.92(a) that would require the staff to prepare a supplement to the final EIS for the CP. The enclosure provides the staffs analysis of the new information.
