In October 2021, Kairos Power submitted the Environmental Report (ER) (Reference 1) as part of the Construction Permit Application (CPA) for the Hermes non-power reactor. In February 2023, NRC staff advised Kairos Power that they had received comments in early December 2022 from a consulting Tribe on the draft environmental impact statement (DEIS) which requested that a cultural resources survey be conducted for the proposed project. The Tribe also informed NRC of its interest in acting as a consulting party under the National Historic Preservation Act (NHPA) and requested that the NRC include its office regarding the development of archaeological monitoring and discovery plans for the Hermes site (Reference 2).

As a result of discussions between Kairos Power and NRC staff, Kairos Power provided associated information to supplement the ER (Reference 3) to aid in future NRC government-to-government consultations with the Tribe. Kairos Power understands that, as a result of ongoing consultation between NRC staff and the Tribe, the Tribe provided written comments to the NRC regarding the supplemental information, which in turn was incorporated into NRC staff feedback to Kairos Power.

To facilitate resolution of the NHPA consultations between NRC and the Tribe, Kairos Power intends to utilize a geoarchaeologist, appropriately qualified under Secretary of Interior (SOI) standards pursuant to Appendix A of 36 CFR Part 61, to develop a methodology for a reconnaissance-level field investigation of the Hermes site and to make appropriate updates to the monitoring information provided in Reference 3, informed by any additional investigation. The results of these additional efforts would be made available to NRC to provide to the consulting Tribe for review and comment. Kairos Power will continue to participate in periodic closed meetings with NRC staff to facilitate close coordination on future actions.
