. Office of Nuclear Reactor Regulation Items of Interest Week Ending February 5,1993 Fitzoatrick The unit is operating at 100% power with no significant operational problems.
The licensee plans to o>erate at full power until the first week in March when the unit will be slut down to replace a degraded recirculation pump inner seal and re) air minor equipment deficiencies identified during the startup process. T11s maintenance outage is scheduled to last approximately 7 days.
An Individual Plant Examination (IPE) review team (NRA/RES) visited the Fitzpatrick F.lant on January 27-29, 1993, to obtain information from the licensee and walk down selected plant systems. The walkdown was conducted to facilitate the preparation of a staff evaluation of the Fitzpatrick IPE. .
The team had no major concerns and found no significant shortcomings with the )
Fitzpatrick IPE.
The NRC staff safety evaluation for the Fitzpatrick IPE is scheduled to be completed by May 1993.
On January 29, 1993, an Order Imposing Civil Penalties in the amount of
$300,000 was issued to the licensee. The staff decided to exercise broad enforcement discretion and reduced the originally proposed civil penalties (EA 92-71 dated September 14, 1992 - 5500,000) by 40%, in recognition of the substantive management changes and recent trend of improved performance, as exemplified by the conservative approach to plant operations exhibited during the recent restart of the Fitzpatrick reactor.
On February 1-5 1993, Region I is conducting a team inspection of the Fitzpatrick motor-operated valve (MOV) program (Generic letter 89-10).
On February 11, 1993, at 12:45 p.m., the NRC staff and New York Power :
Authority (NYPA) will conduct a briefing for the Advisory Committee on Reactor .i Safeguards (ACRS) regarding restart of the Fitzpatrick plant following the extended shutdown. This briefing will focus on the equipment, management, and organizational changes made by NYPA to improve performance at the Fitzpatrick plant as well as the NRC's inspection and assessment efforts to assure that Fitzpatrick was ready for restart, Troian Nuclear Plant Portland General Electric Company (PGE) moved all fuel rods from the Trojan reactor to the spent fuel storage facility. The fuel removal started on January 23, 1993, and was completed on January 27, 1993.
Mr. Ken Harrison, PGE Chief Executive Officer, informed the NRC of the decision to cease permanently the operation of the Trojan Nuclear Plant by a letter dated January 27, 1993. He noted that the decision was based on s uncertainty about-plant-reliability and costs of operations related to the steam generators, and availability of lower cost replacement power.
PGE submitted an application for an amendment for a possession only license, and several related exemption requests on January 27, 1993. The NRC staff is FEBRUARY 5, 1993 ENCLOSURE A ,

reviewing this amendment request and related exemptions. kJditionally, in efforts to reduce its work force, PGE has notified 415 Trojan employees that 1 they will be dismissed-by March 31, 1993. j l

The Vendor Inspection Branch is conducting an inspection of Rosemount, Inc. on ,
February 1-5, 1993. The purpose of the inspection is to review implementation 1 of Rosemount's quality assurance and Part 21 programs with particular emphasis j on the identification of transmitter problems and Rosemount's evaluation and i disposition of those problems.

On January 28 - 31, 1993, P. L. Eng of the Human Factors Assessment Branch, attended a meeting of the Board of Directors for the Society of Women Engineers (SWE) in her capacity as Director of the Mid-Atlantic Region of SWE.
Ms. Eng has been nominated as National Secretary-elect of SWE.
FEMA Meetina Members of the Emergency Preparedness Branch staff are meeting with the Federal Emergency Management Agency (FEMA) on february 4,1993, to discuss various emergency preparedness matters. The items to be discussed include current and proposed changes to the FEMA /NRC Memorandum of Understanding, ,
proposed supplements to NUREG-0654 on emergency preparedness (EP) requirements l for early site permits _(10CFR52) and protective action recommendations for !
severe accidents, and the responses to 2.206 petitions involving offsite EP issues at Turkey Point and Three Mlle Island. ,
ABWR ITAAC Team Review The NRC staff met with GE and representatives of DOE and the nuclear industry from January 11 through January 21, 1993, to discuss the development of ITAAC as part of the certification process.
The team reached technical agreement on a draft of an Introduction (Section .
1.0) and a set of definitions (Section 1.1) for use in conjunction with the -l Design Descri)tions and ITAAC, but it is anticipated that additional review by OGC and oilers may lead to the need for some wording changes.
Ten example systems were discussed during the meeting. These included:

3 In general, these systems were chosen because the designs (and SSAR material) were considered to be relatively complete. The notable exception was the Control Room Area HVAC system and, as a result, significant rework is required for this Design Description and ITAAC. It is also recognized that the 1 completion of other activities, such as the PRA insights, may impact the Design Descriptions and ITAAC. In conjunction with the discussions of the system ITAAC, approaches for the following generic concerns were also 1 developed:

, ITA'4C review process and other matters related to the ABWR, it was decided that the NRC team would develop staff review guidance from the lessons learned during the ITAAC meetings. GE and the industry are expected to also develop their lessons learned. A follow-up meeting at NRC headquarters is planned for the week of February 1, 1993, to discuss the results of these efforts and the need for developing an example of an ITAAC for a building.
pSA Conference The Director of Division of System Safety and Analysis (DSSA) and the Probabilistic Safety Assess'nent Branch staff attended the American Nuclear Society PSA '93 Conference in Clearwater, FL in an attempt to recruit experts in probabilistic risk assessment (PRA). The NRC has had difficulty finding qualified staff in this area in the past. An unexpected number of highly qualified individuals expressed interest in a position at the NRC. DSSA plans to move quickly to fill available positions from this pool of qualified PRA experts.

Office of Nuclear Material Safety and Safeguards items of Interest Week Ending February 5, 1993 Reoraanization of the Office of Nuclear Material Safety and Safeauardi Effective february 7, 1993, certain functions and organizational elements in the Office of Nuclear Material Safety and Safeguards (NMSS) will be reorganized. The organizational changes will provide significant benefits by enabling a more efficient and effective conduct of the HMSS mission through consolidation of fuel cycle facilities activities (safety and safeguards) in a single division.
The new Division of fuel Cycle Safety and Safeguards (FCSS) (formerly the Division of Safeguards and Transportation) will have a new branch created, the Enrichment Branch. The Division Director will be Robert F. Burnett. The Transportation Branch will transfer to the Division of Industrial and Medical Nuclear Safety, and the Branch structure remains unchanged.
Meetina Reaardino low Specific Activity Radioactive Material On February 2, 1993, the Transportation Branch met with the Department of Transportation, the Department of Energy, and the Office of Research's Regulatory Development Branch regarding the transport of low specific activity (LSA) radioactive material. Oak Ridge National Laboratory personnel and an industry member also participated. At the meeting issues related to the transport of LSA, including the classification of LSA and the maximum quantity permitted in a non-accident resistant package were discussed and resolved, fleview of DOE's License Aeolication Annotated Outline for Hiah-level Waste Renository Staff from the Office of Nuclear Material Safety and Safeguards has completed its review of the September 30, 1992, version of the Department of Energy's (DOE's) " Mined Geologic Disposal System Annotated Outline Skeleton Text for the Preparation of a License Ap)lication" (AO). DOE prepares two iterations of the A0 each year, on which tie staff has agreed to review and comment. At this point in the development of the A0, there is relatively little data in it, and the staff's comments have focused on DOE's interpretation of the requirements of 10 CFR 60 and the degree to which the A0 is following the format provided in Draft Regulatory Guide DG-3003, " format and Content for the License Application for the High-level Waste Repository." Of the staff's three previous comments on interpretations of Engineered Barrier System requirements, one has been addressed in this version of the A0 and two are to be addressed in the next version. The staff's comments, on this version of the A0, related to information in the chapters on Overall System Performance Assessment and Land Ownership and Control.
Cintichem Decommissionino Site Visit On February 1, 1993 Nuclear Regulatory Commission staff visited the Cintichem facility in Tuxedo, New York. Cintichem operated a 5-Megawatt (thermal) pool reactor for the froduction of radiopharmaceuticals under the Mediphysics FEBRUARY 5, 1993 ENCLOSURE B
label. Cintichem is licensed by NRC for special nuclear material and
- operation of the reactor and the State of Jtew York for byproduct material.
The facility initiated decommissioning in 1990. The purpose of this visit was ,
to observe and discuss the status of the decommissioning activities at the '
site. Also present at this meeting were representatives from the New York State Department of Environmental Conservation (NYSDEC). Cintichem has proposed two sets of residual contamination criteria for surface and subsurface soil. The subsurface criteria are considerably greater than the surface soil criteria based on the depth of placement of the contaminated soil, a 20-foot thick concrete rubble cover, and anticipated limited use of .
the site after decommissioning is completed. Staff is currently reviewing the licensee's proposal in conjunction with NYSDEC. Under the current license, decommissioning must be completed by January 1995.
Defense loailtics Aaency Assumes Responsibility for Remediation of the Curtis Bay Site On January 29, 1993, Defense Logistics Agency (DLA) staff informed the Nuclear Regulatory Commission that DLA had assumed lead agency responsibility for the remediation of a formerly released portion of the DLA de)ot in Curtis Bay, ,
Maryland. Thorium contamination at the Curtis Bay site las been the subject <
of significant Congressional and local media interest since late 1992. NRC released the site from the active license in 1978. Based on a 1992 survey of '
the Curtis Bay site under contract with NRC, the Oak Ridge Institute for '
Science and Education determined that spotty thorium contamination exists in abandoned buildings and soil at the site. The buildings were formerly used to store thorium nitrate as part of the National Defense Stockpile (NDS). The General Services Administration (GSA) originally held the license for the site, but NDS responsibility was transferred from GSA to DLA in 1988.
Currently, NRC is scheduled to brief Congressional staff about the status of remedial activities on February 18, 1993.
Chemetron Decommissionina Meetina with Officials from the State of Ohio On february 1,1993, representatives of the Office-of Nuclear Materials Safety and Safeguards (NMSS), Office of the General Counsel (OGC), and Region 111, attended a meeting in Columbus, Ohio. The purpose of the meeting was to discuss the onsite disposal cell plans for remediation of the two contaminated Chemetron Site Decommissioning Management Plan sites located near Cleveland, Ohio. Officials from the Ohio Environmental Protection Agency (0 EPA), Ohio Department of Health, Ohio Attorney General's Office, and Chemetron, Inc.,
were in attendance. Discussed was the question of whether solid-tnste permitting from the OEPA is required, since n & radioactive solid waste is also present. The licensee, Chemetron, indicated that permitting should not be required since the proposed action involves remediation of an existing siie, and~ not the creation of a new solid waste disposal unit. OEPA explained that their regulations require permitting, but with. appropriate-justification those permitting nquireronts could possibly-be waived. OEPA also summarized their concerns about the suitabil_ity of the site for an onsite disposal cell, including the distance to the nearest residence, the presence of a surface water stream, the distance to a shallow aquifer, and historical problems within Ohio when ravines are used for solid waste disposal. . 3 that OEPA and Chemetron need to continue their dialogue on the permitting questions, and that the Remediation Plan currently scheduled to be submitted to the Nuclear Regulatory Commission in March should be the vehicle to resolve the permitting issues. It was further agreed that NRC and Ohio regulators should meet again after Chemetron submits their responses to comments generated in the review of the Final Site Characterization Report. The Ohio Attorney General's Office was informally requested to determine the applicability of the Ohio law requiring Below Regulatory Concern (BRC) wastes to be disposed of in a licensed disposal facility. the StatusInQuo (Effective summary, Immediately)b[1ts the Order prohi SLC from taking any further steps to implement the " Asset Purchase Agreement," dated January 4, 1993, without prior Nuclear Regulatory Commission staff approval. Under the January 4, 1993, Agreement, SLC would sell two of its product ~1ines to Shield Source, Inc. (SSI), a Canadian corporation; the principals of SLC and SSI are substantially identical.
The Order is needed to preserve the status quo, to prevent SLC's dissipation of assets required to comply with the Commission's regulatory requirements and its outstanding March 1989, August 1989, and February 1992 Orders and to protect the Commission's jurisdiction in ongoing hearings before the Atomic Safety and Licensing Board (ASLB). The DFl seeks additional information-needed by the NRC staff to determine if additional regulatory action is needed to ensure compliance with regulatory requirements.
In essence, the Order continues the requirements imposed by the ASLB in its January 22, 1993, Crder which expired at 4:15 p.m. on January 29, 1993. On February 2, 1993. SLC filed a motion to set aside the immediate effectiveness of the Order, but withdrew the motion on february 4,1993.

4 Office of Nuclear Regulatory Research Items of Interest Week Ending February 5, 1993 International Consecuence Code Benchmarkino Exercise A meeting of the-0 ECD and CEC countries participating in the international consequence code benchmarking exercise (inc1" ding the NRC's code MACCS) was held at OECD headquarters in Paris, France, January 23-26, 1993. The meetin was held to review the latest draft report of he intercomparison analyses. g '
The final report will be presented to the OECD/ CEC Ad Hoc Committee at a meeting in Madrid, Spain, April 26-30 for their review and approval. In addition to the intercomparison meetings, a meeting of MACCS users was held, at which the various countries using MACCS presented their results of recent w6rk and requested that the USHRC formally establish an international MACCS Users Group.
Public Meetina - Reactor Site Criteria A public meeting was held on February 4, 1993, with NUMARC. This is the fifth such meeting during the past 2 years. During the previous meeting in Septem-ber, NUMARC presented an alternative probabilistic seismic hazard analysis (PSHA) mathod to the )rocedures described in the proposed revision of ,
Appendix A to 10 CFR ) art 100, " Seismic and Geologic Siting Criteria for Nuclear Power Plants," which is currently out for public comments. At the February 4 meeting, NUMARC presented the results of applying its methodology to two sites: (1) a postulated site near Vincennes, Indiana, within an area that geologic evidence for a large earthquake was recently found an'd, there-fore, not considered in EPRI (1989) or LLNL (1988) PSHA's; and (2) Savannah River, where new information significant to the seismic hazard of the site was found that had not been included in previous hazard analyses.
The results of these two evaluations demonstrate the capability of the NUMARC method to accommodate new information significant to_the seismic hazard, at least with respect to these two sites.

Office for Analysis and Evaluation of Operational Daca items of Interest Week Ending February 5, 1993 Diaanostic Evaluation and Incident Investiaation Branch (DEllfu The loss of an Iridium-192 source and therapy misadministration at Oncology Services Corporation Incident investigation (IIT) has concluded its investigation and will be briefing the Commission on February 8, 1993. The llT report will be issued on February 8, 1993.
During the period February 1-5, the second week of the 5th Incident Investigation Team (!!T) training course was conducted. The second week included a workshop on investigative analytical techniques. The case studies were performed using a reactor or nonreactor scenario by each of the 'five teams in the class. The workshop portion of the course was conducted through a TTC contractor with monitoring and assistance by the TTC and DEllB. On February 5, the Ili training course concluded with each team briefing a mock Commission or Congressional connittee, roled-played by NRC senior managers, and Commissioners Curtiss and Remick.
Technical Trainina Center (TTC)
During the week of February 1-5, the first presentation of the Reactor Safety Course (R-800) was successfully completed. The course provided a broad perspective of important reactor safety concepts with emphasis on topics important to reactor risk. Five major areas were covered. The Historical Overview module included design for safety, defense in depth strategy, emergency core cooling system (ECCS) rulemaking, and severe accident and safety goal policy. The Accident Sequence module included safety risk concepts and terminology, accident sequence development, important accident sequences, and individual plant examination (IPE) and individual plant examination of externally initiated events (IPEEE) programs. The Accident Progression in the Reactor Vessel module included fission product inventory and decay heat and core melt progression. The Accident Progression in the Containment module included containment phenomena, reactor cavity and vessel breach phenomena, and hydrogen and combustion events. The Radiological Releases and Consequences module included radionuclide groups, environmental transport. Environment Protection Agency (EPA) protective action guidelines, and emergency res)onse. In addition, there were discussions on the Three-Mile Island and Chernosyl events, accident management principles, and other historical perspectives.
This course was developed by RES, in response to an AEOD user need request, using Sandia National Laboratory. The principal staff delivering the presentations were Dr. Allen Camp of Sandia National Laboratory and Professnr Eric Haskin of the University of New Mexico. This first course presentation had nearly 30 attendees representing all regions, RES, AE00, and NRR. While it will take some time to study and assess course evaluations made by attendees, the preliminary judgment, based on conversations with attendees, is that the course was successful in bringing together many aspects of reactor safety that were previously presented in a fragmented manner or not at all.

L, it is anticipated that the course will go into a production mode in the near-term and that multiple presentations will be made on a schedule to be announced by the TTC.
Also during the week of February 1-5, the first group of Ukrainian SCNRS assignees completed week one of technical briefings and training at the TTC.
This assignment is the initial phase of the implementation plan for Ukrainian Friority 2 (Est G1 hhment of Regulatory Training Program) as negotiated at a d
natig in kiu during November 1992. The Ukrainian delegation consists of Vladimir Frolov (Head of the NPP Personnel Licensing Inspectorate, SCNRS).
Alexander Koretsky (Chief, Technical Inspection Department, SCNRS), Valentina Stovbun (Head of Staff Division, SCNRS), Nikolai Koba (Chief Inspector, Khmelnitsky NPP, SCNR3), Valery Lomakin (Senior Technologist, SCNRS), and Oleg Gurerchuk (Interpreter, SCNRS).
This first week of their 6-week assignment focused on training that is conducted by U.S. utilities. In addition to briefings on the Institute of Nuclear Power Operations (INPO) accreditation process and the systems approach to training, separate briefings were given on the training provided for utility engineering support staff, radiological protection personnel, chemistry technicians,-mechanical maintenance personnel, electrical maintenance personnel, instrumentation and control personnel, non-licensed operators, shift techaical advisors, re-tor operators, and senior reactor operators. All of these briefings were conducted by TTC staff.
The second and third weeks of this assignment will cover the structure of NRC technical training and will focus on what is done, why it is done, and the differences between utility and regulatory training. The fourth and fifth weeks of this assignment will include the essence of the Fundamentals of Inspection Course and Inspecting for Performance Course. The last week of the assignment will cover the process for conducting licensing examinations of operators in the U.S. and the methods used. Other groups of Ukrainians and similar groups of Russit.ns.are scheduled for assignments at the TTC throughout 1993.
Incidq1t Response Branch (IRB)
During the past week, IRB staff members participated in an OECD Experts meeting in Switzerland to discuss the upcoming Emergency Response Tabletop exercise to be held in April 1993. They are also observing an emergency preparedness exercise being conducted at the Muhlenberg plant-in Switzerland.
An IRB staff member participated in a State Outreach Program meeting in Sacramento this week with the State of California. The primary emphasis of the meeting was on the provision of technical assistance to states and the revised sta$ support guidelir.es being implemented by the American Nuclear Insurers.
On February 3, an IRB staff member participated in the Training Subcommittee of the federal Radiological P.aparedness Coordinating Committee.

Reactor Operations Analysis Branch (ROAB)
On January 28, 1993 Dr. Harold L. Ornstein visited Diablo Canycr, to review turbine overspeed issues and turbine building hazards as a followup to the Salem overspeed event. In the course of discussion, he noted human factors enhancements that Salem had made - in particular, placement of a stationary handle on the turbine test panel. The handle would prevent an inadvertent tri ) (which could be caused by operator fatigue during turbine testing).
Altlough industry reports have been written on the Salem event, information on the aforementioned human factors enhancement has not been disseminated to industry. Two days later, Diablo Canyon Unit 2 experienced such a trip.
Subsequently AEOD forwarded a photograph of Salem's enhanced turbine test panel to Diablo Canyon Staff. This issue will be addressed in AEOD's special report on turbine overspeed.

Office of Administration items of Interest Week Ending February 5, 1993 pWFN - Fire Annunciator Panel A fire annunciator panel was installed in the Administrative Services Center (ASC) on January 15, 1993. The panel monitors the fire detection components throughout the building and alerts ASC via an audible and visual alarm when any component has been activated. The panel enhances our ability to quickly respond to potential-fire emergencies. All ASC staf f members have received training regarding their responsibilities to perform daily testing of the panel and the actions to be taken when the panel is in a trouble or alcrm status.
Aeolied Science Associates Contract Under NRC's contract with Applied Science Associates, Inc., the Contracting s Officer issued a final decision on July 31, 1992 denying a claim in the amount of $86,288 for a cost overrun due to final indirect rate increases. Applied Science Associates, Inc. filed an appeal of the Contracting Officer's decision with the Department of Energy Board of Contact Appeals on January 8, 1993.
The RRC filed a motion for dismissal on January 22, 1993 for Applied Science Associate Inc.'s failure to certify its contract claim with the NRC's Contracting Officer. A decision is due from the Board within 120 days.
RFP issued A Request for Proposal entitled " Voice Messaging System Replacement" was issued on January 29, 1993. This effort provides for installation of a new

A proposed rule entitled " Procedures and Criteria for On-Site Storage of Low-Level Radioactive Waste" was published in the Federal Register on' February 2, l 1993 (58 FR 6730). The proposed rule would establish a regulatory framework containing the procedures and criteria that would apply to the on-site storage of low-level radioactive waste beyond January 1,1996. The Connission has determined that the proposed changes are appropriate because of potential health and safety concerns associated with the increased reliance upon on-site storage of low-level radioactive waste. The comment period for the proposed rule closes April 5,1993.

DE Boiler and Pressure Vessel Code CD-ROM Trainina The Library staff recently made arrangements with-the Information Handling Service to provide training on accessing the American Society of Mechanical Engineering Boiler Pressure Vessel Code using CD-ROM. Training sessions are scheduled for February 5, 1993,.9:00-10:00 a.m., Room 4C16, White Flint Reading Room, and February 11, 1993, 9:00-10:00 a'.m., Room 043-NLS, Nicholson Lane Branch Library. Additional training sessions can be scheduled by contacting the library on 492-8363.
Soecial Proiects As a followup to IRM efforts to reduce paper, the File Center commenced purging the duplicate license amendment records maintained as part of the License Authority files. This set of records is no longer-needed because all of the involved records are now processed through NUDOCS (Nuclear Documents System). Thirty-five cubic feet of records were purged.
The File Center has commenced reorganizing-retired records to group by date all records within a -10 CFR Part 50 docket case file =to eliminate the-commingling of files with different license expiration dates. Thirty cubic feet of records have been reorganized.

Office of Personnel Items of Interest Week Ending February 5, 1993 Recent Recruitment Activities NRC representatives attended the Minority Career Fair at Georgia Institute of Technology on January 21, 1993. Students identified as having potential for the NRC Intern Program were scheduled for interviews the following day. This resulted in seven highly qualified students being recommended for positions with the NRC.
On January 25 and 26, NRC staff attended a Career Fair and conducted on-campus interviews at Florida International University. Twelve highly qualified '
students were identified for consideration as NRC interns. NRR, AE0D, and Region 11 expressed interest in these applicants with further interviews recommended.
NRC attended the American Nuclear Society Probabilistic Safety Assessment (PSA) Conference on January 26 and 27 in Clearwater Beach, Florida, to focus on recruiting attendees with PRA backgrounds for positions in NRR. As a result, six individuals were interviewed during the conference. Follow up regarding these individuals is continuing.
NRC representatives from Headquarters and Region 11 attended the University of Florida Career Fair on January 28 and 29. Of the 28 students interviewed for NRC positiens, 14 students were recommended for further interviews.

Plan (IDP) workshops were held in Region 1. Twenty-five employees from both supervisory and non-supervisory staff were coached about the IDP process and how to prepare the IDP forms.

Office of Fnforcement Items of Interest Week Ending February 5, 1993 Sionificant Enforcement Action An Order Imposing A Civil Penalty in the amount of $7.500 was issued on February 3,1993 to Capital fiaterials Testing, Inc., Ballston Spa, New York.
The action was based on a violation invviving a failure to adequately perform a survey of a radicaraphic device after a radiographic exposure was completed.
The licensee responded to the Notice in a letter dated December 9,1992. In its response, the licensee did not deny the violation, but requested remission of the civil penalty. After careful consideration of the licensee's reponse, the staff has concluded that the violation did occur as set forth in the N;tice of Violation and Proposed Imposition of Civil Penalty and that the licensee failed to provide a basis for any mitigation of the civil penalty amount. Civil Penalties Paid
- 1. Caribbean Soil Testing Company, Inc., San Juan, Puerto Rico, paid the civil penalty in the amount of $375. The action was-based on a Severity Level III violation for failure to properly secure a moisture density gauge. The gauge was stolen from a licensee truck parked in front of the licensee's facility. The gauge, still locked, was recovered by the police three days later. The base civil penalty of $500 was mitigated 25 percent for corrective actions. The other factors were considered but no further adjustment was warranted. A violation for failure to report the theft immediately by telephone was cited at Severity Level IV. The licensee notified NRC by letter dated the day of the theft.

- 2. Geo Cim, Inc., Hato Rey, Puerto Rico, paid the civil penalty in the amount of $375. The action was based on a Severity Level III violt. tion for failure to properly secure a moisture density gauge. The gauge was in the back of an open-bed pickup truck p&rked on a residential street, and was neither properly secured nor under constant surveillance by the licensee. The box containing the gauge was not locked, and the key to the gauge was in the box. The base civil penalty of $500 was mitigated 25 percent, based on 50 percent escalation for NRC identification, 25 percent mitigation for corrective actions, and 50 percent mitigation for licensee performance. Two other violations were also cited at Severity level IV. (EA 92-238)
- 3. Northeast Nuclear Energy Company (Hillstone Unit 3) paid the civil penalty in the amount of $62,500. The action was based on two violations involving the operation and testing of the unit's auxiliary building filter system and supplementary leak collection system.
Specifically, it was determined that the systems have been operated since plant startup in configurations that would not ensure that accident condition radiological releases were properly processed and it was also identified that periodic testing of the systems was inadequate to detect the problems. classified as a Severity Level III problem. The base civil penalty in this case has been escalated 25 percent to $62,500 based on 100 percent escalation for prior opportunities to identify the problem, 50 percent mitigation for licensee identification, and 25 percent mitigation for corrective actions. - 4. Gulf States Utilities (Riverbend Station) paid the civil penalty in the amount of $100,000. The action was based on 15 violations in which radiation surveys were not performed as required, radiation protection procedures were not followed as required, and contamination material was disposed of by transfer to an unauthorized recipient. Collectively, these violations are considered to represent a Severity Level III problem. Mitigation for good corrective action was offset by escalation for poor prior performance in the health physics area. However, in order to convey the significance of this violation, the civil penalty has been escalated by 100 percent of the base civil penalty.

- 5. The South Dakota Department of Transportation (SD DOT) civil penalty and Cemand for Information in the amount of $3,400. The action was based on several violations identified during an investigation and inspection of the SD D1T facilities in Brookings and Pierre, South Dakota, regarding the reported theft of a moisture / density gauge. The specific violations involve: (1) the failure to maintain constant surveillance of licensed material; (2) the failure to provide complete and accurate information to the NP.C; (3) the failure to meet a number of requirements related to the transportation of radioactive material, and (4) six failures to meet the administrative requirements contained in NRC regulations. The failure to secure licensed radioactive material against unauthorized remaval was classified at Severity Level 11 because (1) the violation resulted in a significant potential for inadvertent radiation exposure to a member of the public and (2) the SD DOT employee's actions (leavir.g the device unsecured and unattended for 1.5 hours5.787037e-5 days <br />0.00139 hours <br />8.267196e-6 weeks <br />1.9025e-6 months <br /> in a public parking lot) showed a careless disregard for the NPC requirements that are designed to prevent the loss of such material. In addition, the willful failure on the part of two individuals to provide complete information to the RSO and to ensure that the information provided to NRC was complete and accurate was classified as a Severity Level Il violation.
The violations associated with the transport of the gauge indicate a potentially significant lack of attention toward licensed responsibilities and were classified collectively as a Severity Level 111 problem.

On February 3, GSA directed the developer to submit a price proposal on a complete replacement of the waterproof membrane for the exposed deck over the OWFN garage.
Also on February 3, the developer delivered copies of the TWFN interior construction drawings to GSA and-the NRC for review.
The Director was informed during the week by a State Highway Administration engineer that-the pedestrian hazard in front of TWFN had now been discussed with the County Department of Transportation, the County Planning Board staff and the developer. So far, none has accepted responsibility for abatement of-the hazard.

Items of Interest Week Ending February 5, 1993 Meetino of EPA's Science Advisory Board Executive Committee Maria'Lopez-Otin, Federal Liaison, attended the full meeting-of.the Environmental Protection Agency's (EPA) Science Advisory Board (SAB) Executive Committee on January 28-29, 1993. Of interest to the NRC was the discussion of the Radiation Advisory Committee's " Report on C-14 Release from High-Level Waste Disposal" which was submitted to the SAB for-approval. A number of changes to the report were proposed. A significant one related to the best H way to express the number of potential cancer fatalities. After comments are-considered by the RAC, a final report is expected in early April.
Also on interest to the NRC was the statement made by Ms. Carol M. Browner, the new EPA Administrator. Ms.-Browner was meeting with the SAB for the first time. She spoke of her desire to make the EPA an agency whose decisions are based on sound science, as well as, on local communities views, including their perspectives. Ms. Browner noted her view that it is time to look at whole ecosystems when making decisions. For example, she cited her experience as Director of the Florida Department of Environmental Regulation where whole aquatic ecosystems were protected instead of individual waterways. Ms.
Browner stated that she sees the potential elevation of EPA to cabinet status as an opportunity to highlight not only EPA's regulatory role,-.but its role as a national leader in environmental science. Ms. Lopez-Otin met Ms. Browner and obtained a copy of Ms. Browner's first memorandum to all EPA employees and of her opening statement before Committee on Environment and-Public Works.
National Governors' Association Winter Meetina Carlton Kammerer, Directur, Office of State Programs, and Spiros' Droggitis, State Programs, attended the National Governors' Association (NGA)' Winter Meeting on January 31 - February 2, 1993 in Washington, DC. The Governors reaffirmed the NGA's existing comprehensive national energy- policy and adopted new policies on the cumulative demands of environmental regulations on State and local capacity and the implementation of the Federal Facilities Compliance Act of 1992. The NGA may'ccasider revisions to the energy policy at its annual meeting on August 15-17, 1993 in Tulsa, Oklahoma.
5-Week Health fhysics Course State Programs is sponsoring a health physics course at the Oak Ridge Institute for Science and Education which began on February 1,1993 and will run for 5 weeks. The class consists of twenty-one. students from State radiation control programs and one NRC staff member.
NRC/ FEMA Workshoo Plannina Meetina Charles. Hackney, Region IV State Liaison Officer, participated in a planning meeting for an upcoming workshop with representatives from the Federal Emergency Management Agency (FEMA) and the State of Arkansas on February 3, 1993 in Little Rock, Arkansas. - 1. Pilarim Region I and NRR officials conducted a public meeting at 7:00 p.m., on Wednesday, February 3, in Plymouth, MA, to give updated information about the reactor water level instrumentation in Pilgrim, and to take comments and answer questions from local officials and the public.
- 2. Oyster Creek On January 25, 1993, the Oyster Creek facility was exiting a special test condition for testing the main steam isolation valves when it was--
determined that the plant may have inadvertently changed operating modes. The test conditions resulted in degraded core cooling ~and a water temperature rise to above 212' F. for a short period of time. An Augmented Inspection Team was dispatched on January 26, 1993. On February 2, 1993, the AIT completed the onsite review of the degraded shutdown cooling event. The public meeting exit is scheduled for February 8, 1993. The licensee estimated a peak water Temperature of 250-270' F. which was below saturation, given that the in-progress test' established a pressure of about 45 psig.
There was minimal risk to the public associated with the event. The core water temperature was above 212' F. (without primary containment) for less than two days. Some core flow did occur and there was low decay heat (~ 1 MW), so the-heatup transient was very slow with about 15 feet of water over the core throughout the event. The abnormal: plant configuration was limited in duration and restoration had already begun when the elevated-temperatures were identified. The test related to the configuration required maintaining pressure within a narrow band so-steam-caused pressure increases would have been immediately detected.
- 3. Enforcement Conference with National Institutes of Health On February 4,1993, a closed enforcement conference was conducted with

the National Institutes of Health,.Bethesda, MD. The conference discussed an extremity overexposure to a research technician using phosphorous-32, that occurred on November 17, 1993. The causes of the overexposure and the licensee corrective actions were presented.
Enforcement action is pending.

- 1. Virainia Electric and Power Company On February 4, Commissioner Curtiss, accompanied by the Director of.
Division of Reactor Safety and members of their staff, visited the Virginia Electric and Power Company's North Anna facility. The visits coincides with the physical movement of steam generators being replaced in Unit 1.
- 2. Carolina Power and licht Company On February 4, the Regional Administrator and the Assistant Director for Region II Reactors, NRR, were at the Brunswick facility to attend a public meeting concerning the BNP restart status and to meet.with the Resident Inspectors.
On February 4 Shearon Harris participated in the first of five medical emergency helicopter evacuation exercises planned with Carolina Air Care. Scheduled for five consecutive Thursdays, these exercises are being performed in order to facilitate the helicopter evacuation of injured persons who are potentially contaminated. As usual, .the helicopter evacuation site is located-in the parking lot outside the protected area.
- 3. Commissioner Curtiss Visit to B&W Commercial Fuel Plant On February 3, 1993, Commissioner Curtiss, accompanied by the Deputy Regional Administrator and the Chief of.the Radiation Safety Projects toured facilities associated with B&W Nuclear Technologies-(including the Nuclear .0 arts Center), B&W Special Products and Inspectior. Services (with emphasis on robotics for steam generator repair and replacement),
and the B&W Commercial Fuel Plant.
- 4. Tennessee Valley Authority On February 5, representatives from tne Tennessee Valley Authority were in the Region II Office to attend an Enforcement Conference regarding Essential Raw Cooling Water (ERCW) valve mis)osition resulting in over-

As a result, the enforcement conference that was scheduled for February 4, .1993, to discuss apparent violations relative to an event at'STP in which the control room operators were not-promptly informed of a Technical Specification surveillance deficiency has been postponed.

Sellman has been selected for the position of General Manager, Plant Operations, effective February 17, 1993.
Mr. Sellman is currently the plant manager at Prairie Island Nuclear-Plant z.nd has been with Northern. States Power Company for 18 years.
