With all due respect, three weeks ago following the LAR pre-submittal meeting, you and I talked about pulsing NRR and the region as to whether they had any heartburn or churn from our February 13 pre-submittal meeting. I called NRR to pulse them later that same day after the pre-submittal meeting and I shared that communication with you and Erin. Erins initial email on Thursday said that she called Tony Gody and asked him about the lack of NRC feedback to our January 2016 letter, and her second email clarified that she asked him why there was no NRC executive feedback to our January 2016 letter. Thats a very different communication than you and I talked about.

Im not sure why, now, 2 years after we submitted the Observation letter and one year after a RII Branch Chief directly called and candidly told us they were not going to provide a written response, we would be questioning the region as to why there was no NRC executive response to a fairly innocuous letter; I would never have expected to hear from NRC executives

for that type of letter. The only thing I kept hearing frequently from RII was that our letter was typically referred to as, the non-denial denial letter, and TVA was now known as the non-denial denial Fleet; i.e., it damaged our reputation.

Somewhat troubling is that Erin and I discussed the status of the LAR on the 0730 Fleet Licensing Alignment call on Thursday 3/1 morning. During that call, I noted we scheduled a special PORC that afternoon, and I asked Erin if you or she had reviewed the LAR and if you were ready to sign. I emphasized that only a few weeks prior, CNL told the NRC (during 2/13 LAR pre-submittal meeting) we would submit by the end of February, thus it was important that we be prepared to submit after PORC approval.

(Note also that last June, we told the NRC we would submit by end of September 2017.) Erin responded she had seen an earlier version of the LAR, had not read it in detail, and was unsure what the current version looked like. Less than 2 hours2.314815e-5 days <br />5.555556e-4 hours <br />3.306878e-6 weeks <br />7.61e-7 months <br /> later that same morning, I received her email describing her call to Tony Gody, and recommending we now hold off on submitting the LAR.

I fully understand and appreciate the importance of strategic CNL periodic discussions with NRR and the region, but I think it is completely inappropriate for that type of call (the 3/1/18 call) to be made without first communicating to/with the impacted site. As you know and have, yourself, emphasized previously to the sites, every time we give the NRC a planned action or submittal date, and then fail to deliver, we further erode regulatory confidence and regulatory margin. I am concerned that these types of situations result in continuing to damage TVAs reputation with the NRC.

As for the discussion on the Kirk key, just as when the governance was structured when you were in corporate, there is a defined role for corporate leadership with regard to the relationship with NRC up to and including the CNO. In this case, in a phone call several weeks ago, you and I discussed that Erin, in her role, would soon do some outreach to RegionII DRS/D Gody regarding the SQN issues to parallel your discussions at the Branch Chief level. I am not sure why that comes across as

  • Regulatory Analysis:
  • Potential freezing of bent ERCW motor cooler piping (CR 1380212). Evaluate past unavailability of ERCW pumps due to standing water in lines and freezing weather conditions. Risk assessment in progress.

GE evaluation due 2/23; POE will be completed after GE evaluation. RA due 3/6

- status Per discussions earlier this week, the final GE evaluation was received Friday 2/23 and the POE completed Saturday 2/24 with the conclusion that there were no periods where we exceeded LCO. PRA completed the risk analysis a few weeks ago (prior to receipt of GE analysis) and, conservatively assuming the frozen lines would have caused pump inoperability, the result was still Green. The GE evaluation makes it a moot point (pumps were always operable). NRC was briefed on POE results Tuesday 2/27 and thus far have no issues. We plan to cancel the RA.

  • Operability/Reportability/Other NRC Issues:
  • Incorrect breaker installation (20 vs. 50 A) based on drawing error - POE status?
  • Inspections in progress: none
  • Upcoming inspections:
  • Security Baseline (3/5-9) - any known issues? No known issues.
  • IP 95001 inspection preps - IT SGI control White Finding issued 12/13/17. Inspection confirmed scheduled March 26-30. Mock inspection complete with actions. Action plan drafted with additional feedback to be incorporated; training execution and effectiveness assessment plan due 2/16 with observations positively influencing future training; fleet challenge on 2/22 concluded ready for inspection.
  • Inspection item tracking:
  • EQ inspection - formal exit on 12/11/17 (4 NCV, 5 URIs, 1 minor); information exchange with NRC ongoing; re-exit on 1/19 with 2 NRC-identified green NCVs, 4 URIs and 1 Minor Violation. 1 URI done; contract support for other 3 URIs. Expect final evaluations to site licensing by 02/23; draft responses being reviewed by 3rd party -

status? Final Evaluations now due 3/9 to incorporate external peer feedback.

  • Other items of interest:
  • Kirk key/EQ Service Life item for mild environment next steps. Kirk key - moving forward with LAR; incorporating feedback from pre-app meeting and peer team discussion; passed PORC. Corporate Regulatory Affairs needs to address the status of this very significant issue. The site has been pushing Corporate Regulatory Affairs to complete and issue the LAR (originally scheduled to be submitted in September 2017, and more recently, just three weeks ago, during LAR pre-submittal meeting we informed NRR that it would be submitted by end of February 2018). LAR was approved by PORC on 3/1/18 (at the request of Corporate Regulatory Affairs, a special SQN PORC for this LAR was convened on Thursday March 1, 2018) but submittal is now delayed again by unexpected

Corporate Regulatory Affairs senior management communications with RII management personnel. Neither SQN Site Licensing nor any other SQN personnel had knowledge of the Corporate Regulatory Affairs communications with RII until after the fact, which should never happen.

Corporate Regulatory Affairs needs to establish explicit fleet governance to preclude a repeat of this type of issue; Corporate Regulatory Affairs should not discuss site specific issues with NRC management without first consulting/communicating with the affected site. These types of issues create unnecessary regulatory exposure for the sites (there are multiple examples over the past two years). This particular non-compliance has now existed for 2 1/2 years, leaving the site exposed to additional potential enforcement action for neither denying the violation (SQN attempted to submit a denial in 2015 but Corporate Regulatory Affairs did not concur) nor taking corrective actions.
