Gentlemen:
This responds to your letter dated November 18, 1987, to Mr. Charles MacDonald relating to the General Nuclear Systems, Inc. (GNSI) application for approval of a spent fuel cask filed with the NRC on October 29, 1987. You state that the November 18, 1987, letter supersedes in its entirety your October 29, 1987, request.
Your November 18, 1987 letter, requests that the Certificate of Compliance be issued to the Department of Energy (DOE). The Licensing Staff in the Office of Nuclear Material Safety and Safeguards has informed us that if the Certificate of Compliance is to be issued to DOE, then DOE must be the applicant, not GNSI, and that DOE should file l such a request with the NRC. Based on a telephone call from Mr. Dave ,
McGinty of the Oak Ridge National Laboratory, it was our understanding that DOE would file the application. If DOE is the applicant and the '
l certificate is issued to DOE, then the application will be exempt from t fees in accordance with 10 CFR 170.11(a)(5). If DOE does not apply for the certificate, then an application fee of $150 is required as .
specified in 10 CFR 170.31 Category 10A to begin the processing of the i application.
