REVIEW OF DRAFT FINAL RULE ON SAFEGUARDING FOR SPENT FUEL AND HIGH-LEVEL RADIOACTIVE WASTE l l

The Rules and Directives Branch has reviewed the draft final rule that would clarify safeguards requirements for spent nuclear fuel and high-level radioactive waste stored at various operating I sites. '

Attached is a marked copy of the draft rule, to which we have added the list of subjects for Part 74, the authority citation for each affected Part in the rule, the Small Business Regulatory Enforcement Faimess Act statement, as well as some editorial and format changes that should be incorporated in the rule. i The Small Business Regulatory Enforcement Faimess Act of 1996 provides Congress with the l opportunity to review agency rules before they go int effect (5 U.S.C. Chapter 8). The Act i requires agencies to submit a report transmitting a copy of each final rule to each House of Congress and the General Accounting Office before the rule takes effect. The report must j include a concise general statement conceming the final rule, indicate whether the action is a

" major" rule as defined by the legislation and determined by the Office of Management and Budget, and state the anticipated effective date of the final rule. The report must be l accompanied by a copy of any applicable analyses developed in support of the final rule. In addition, the legislation mandated that the effective date for a " major' rule may.be no earlier than 60 days after the date of Congressional receipt of the required material or publication of the final rule in the Federal Register, whichever is later. We have attached a list of addresses '

for the required communication and inserted necessary language in the text of the final rule.
