NUCLEAR REGULATORY COMMISSION ATOMIC SAFETY AND LICENslNG BOARD PANEL

$, [ WASHINGTON, D.C. 20555 January 28, 1987 MEMORANDUM FOR: William J. Olmstead Assistant General Counsel for Rulemaking and Fuel Cycle Office of the Genera unsel i

FROM: B. Paul Cotter, Jr.

Chief Administrativa Judge

SUBJECT:

COMMISSION PAPER ON RELATIONSHIP BfTWEEN INVESTIGATIONS / INSPECTIONS AND ADJUDICATIONS -

CODIFICATION OF PROCEDURES FOR RESOLVING CONFLICTS CONCERNING THE DISCLOSURE OR fl0NDISCLOSURE OF INIORMATION We concur in the basic premise underlying option 2 that a comple:t set of controversial rules is unnecessary to deal with an increasingly rare problem of a type that has generally been handled satisfactorily on an ad hoc basis. The existing policy statement is a sufficient statement R the Commission's desires to provide guidance to Licensing Boards in difficult cases.
