RELATIONSHIP BETWEEN INVESTIGATIONS / INSPECTION AND ADJUDICATIONS - FINAL RULE ESTABLISHING PROCEDURES FOR RESOLVING CONFLICTS CONCERNING THE DISCLOSURE OR N0NDISCLOSURE OF INFORMATION At Mr. Olmstead's request, I enclose the latest version of the subject package for your review.
Please note that the text of 62.781 used in the draft final rule and mentioned in the first full paragraph on page 3 of the draft Commission paper is the text used in the Commission's proposed rule to amend 10 CFR Parts 0 and 2 to revise the ex parte and separa-tion of functions rules applicable to formal adjudi-catory proceedings (51 FR 10393 at 10401, March 26, 1986.)
It is my understanding that this text is likely to be retained in the final rule which is expected to be forwarded to the Commission for action by the end of November.
