As wc discussed earlier, TVA has asked to defer payment of the proposed cps in the subject cases while they appeal to the courts. OE thinks that is satisfactory and proposes to send the letter in the attached file. Would you take a look at the OE proposed response and let us know what the Region thinks? We would like to get the Region's concurrence (if the Region agrees) this afternoon so that Jim Lieberman can sign this before he leaves fnr Atlanta at mid-aftemoon. ,

01 REPORT 2-96-009; RE: SEQUOYAH, ALLEGED FALSIFICATION OF FIREWATCH JOURNALS The above captioned OI report involves an allegation that two firewatch personnel failed to patrol their assigned areas and documented the firewatch journals as though they had completed their patrol. Although 01 did not substantiate that the employees' actions were either intentional or willful, the evidence developed substantiates that both individuals failed to patrol their assigned areas and falsified their firewatch journals. Both individuals were subsequently terminated.

Because 01 did not . substantiate willfulness, I do not intend to request an 0GC analysis of this report or request a multi-office meeting. However, enforcement action may be warranted against the licensee as well as the individuals. Therefore, the region should be prepared to address the enforcement implications associated with the inaccurate information and failure to fol, low procedures during the regularly scheduled enforcement panel on February M , 1997. If your staff cannot support this schedule, please contact Rense Pedersen of my staff at 301-415-2742 as soon as possible.
