JL wants to brief Milhoan this moming on this case, so he has asked me to insert some words re: SWEC corrective action that we are likely to use. In the "You are required..." paragraph, I am adding "In addition, your response should specifically address the actions you have taken to remedy any chilling effect that might exist due to this violation." If these are not the perfect words. they can be changed, but JL needs something to take to Milhoan.

Browns Ferry Nuclear Plant l Docket Nos. 50-259, 50-260, 50-296 Sub.iect: PROPOSED IMPOSITION OF CIVIL PENALTY - $80,000 )
This is to inform the Commission that a Notice of Violation and Proposed Imposition of Civil Penalty in the amount of $80,000 will be issued on or about February 14, 1996, to Tennessee Valley Authority. The action is based on a Secretary of Labor's finding that the licensee's contactor, Stone &
Webster, discriminated against a former ironworker general foreman who raised concerns about firewatch requirements. A Severity Level II NOV is also being issued to Stone & Webster.
It should be noted that the licensee and contractor have not been specifically informed of the enforcement actions. The schedule of issuance and notification is:
Mailing of Notice February 14, 1996 Telephone Notification of Licensee February 14, 1996 and Contractor The State of Alabama will be notified.
The licensee has thirty days from the date of the Notice in which to respond.
Following NRC evaluation of the response, the civil penalty may be remitted, mitigated, or imposed by Order.
