SUNFIDWER'S EXCEPTIONS 1D MEMORANDUM AND ORDER CONuutNING ADMISSIBILITY OF CONIENTIONS ON DERGENCY PLANS AND MorrION 1D DISMISS Now comes Sunflower Alliance, Inc. , (" Sunflower"), Intervenor herein, by and thmugh counsel, and pursuant to 10 CFR $2.762, takes excepticn to the January ll,1985 "Memorandtm and Order (Adnissibility of Contentions on Dnergency Plans and Motion to Dismiss)" and the "Erratun (Dnergency Planning Contention)" issued January 15, 1985. Comsel for Intervenor represents that he received the Jamary 11, 1985 order only cn Jenuary 21, 1985 for the reason that it apparently had been retumed to the NBC for postage.

In stpport of its exceptiens, Smflower states that the Atcmic Safety and Licensing Board was without procedural authority to entertain a noticn to dismiss at this stage of the proceeding. Further, Sunflower states that the decision excluding particularized ccntentions D, E, F, K, L, N, R, S, T, . V, W, X, Y, AA, EE, FF,111, II, KK, and LL~ fran this proceeding was made against the manifest weight of the evidence and ccntrary to substantive and procedural law.

NHEREFORE, Smflower prays the Atomic Safety and Licensing Appeal Board to hear these exceptions on their nerit briefs, and upon such delibera-tions, to reverse the Atanic Safety and Licensing Board's determinations in all respects.
