U.S. NUCLEAR REGULATORY COMMISSION STAFF REVIEW OF REQUEST TO TERMINATE SPECIAL NUCLEAR MATERIAL LICENSE NUMBER 2016 FOR PASSPORT SYSTEMS INC. (ENTERPRISE PROJECT IDENTIFIER L-2019-LLA-0224)

Dear Mr. Johnson:

By letter dated November 20, 2019 (Agencywide Documents Access and Management System

[ADAMS] Accession No. ML19309E666), the U.S. Nuclear Regulatory Commission (NRC) staff notified you of its receipt and acceptance for further technical review of your submittal dated October 16, 2019 (ADAMS Accession No. ML19290E196), requesting the NRC to terminate Passport Systems, Inc.s, Special Nuclear Material License Number 2016 (SNM-2016). In its acceptance letter, the NRC staff stated that based on its preliminary evaluation and projection of current review schedules, it anticipated completing the review of your license termination request by January 31, 2020, and that this date could change depending on the findings of the NRC staffs technical review, urgent assignments, or other factors. The NRC staff also stated that it will promptly communicate any significant changes to this schedule.

During the review of your request, the NRC staff identified an issue regarding Passports possession of depleted uranium (DU). By electronic mail to Mr. Steve Korbly, Radiation Safety Officer, dated January 2, 2020 (ADAMS Accession No. ML20009E332), the NRC staff requested clarification of the information Passport provided in its license termination request regarding the quantities of DU that Passport will still maintain after the NRC terminated the SNM-2016 license. On January 20, 2020, in response to a follow-up email from the NRC staff, Mr. Korbly replied that Passport had been coordinating with the State of Massachusetts (MA) to provide the clarification (ADAMS Accession No. ML20027A313). In Mr. Korblys email he also provided contact information for the MA staff Passport is coordinating with.

On January 23, 2020, the NRC staff contacted the MA Radiation Control Program to inquire about Passports coordination with the State staff on the DU issue. During the call, MA staff confirmed that Passport has contacted them and stated that they are looking into this matter.

The MA staff also stated that resolution of the issue may take several weeks.

P. Johnson 2 Based on the information discussed above, the NRC staff determined that review of Passports request for terminating the SNM-2016 license cannot be completed by January 31, 2020. The NRC staff determined that further action regarding your license termination request cannot be taken until the DU issue is resolved. Therefore, the NRC staffs review of Passports license termination request is being placed on hold until the DU issue with the State of MA is resolved and the appropriate documentation supporting the resolution is provided to the NRC.

In accordance with Title 10 of the Code of Federal Regulations, Section 2.390, Public inspections, exemptions, requests for withholding, of the NRCs Agency Rules of Practice and Procedure, a copy of this letter will be available electronically for public inspection in the NRC Public Document Room or from the Publicly Available Records component of the NRCs ADAMS.
