C-10 RESEARCH AND EDUCATION FOUNDATIONS MOTION FOR LEAVE TO FILE REPLY TO OPPOSITIONS BY NEXTERA AND NRC STAFF TO EMERGENCY PETITION I. INTRODUCTION Pursuant to 10 C.F.R. § 2.323(b), C-10 Research and Education Foundation (C-10) hereby moves for leave to replies to oppositions submitted by NextEra Energy Seabrook (NextEra) and the U.S. Nuclear Regulatory Commission (NRC or Commission) Staff to C-10s Emergency Petition for Exercise of Commissions Supervisory Authority to Reverse No Significant Hazards Determination and Immediately Suspend License Amendment and License Renewal Decisions (Feb. 13, 2019).

C-10 seeks leave to reply in order to briefly and succinctly correct the record on a number of issues, including NextEras and the Staffs incorrect characterization of the Commissions standards for taking discretionary review of emergency petitions to exercise the Commissions inherent supervisory authority; whether C-10s petition is barred by NRC regulations; whether C-10 has waived any rights to bring its Petition; and the merits of the NRC Staffs arguments that it has indeed provided adequate oversight to NextEra in the development of testing, analyses, and standards for evaluation of ASR. Petitioners respectfully submit that an opportunity to submit a reply (which totals less than ten pages) is necessary to ensure that the Commission has a complete and accurate record on which to rule.
