CENTRUS ENERGY CORP. - AMERICAN CENTRIFUGE OPERATING, LLC - TRANSFER OF CERTAIN AMERICAN CENTRIFUGE LEAD CASCADE FACILITY PROJECT MANAGEMENT AND CORRESPONDING INSPECTION FUNCTIONS WITHIN THE NRC (DOCKET NUMBER 70-7003)

The purpose of this memorandum is to provide notification about the transfer within the NRC of portions of the project management function from the Division of Decommissioning, Uranium Recovery, and Waste Programs (DUWP) to the Division of Fuel Management (DFM) and portions of the inspection function from Region III to Region II for Centrus Energy Corp.s (Centrus) American Centrifuge Lead Cascade Facility (LCF) (License No. SNM-7003) located in Piketon, Ohio.

While the LCF was being decommissioned, responsibility for managing the safety review of the LCF decommissioning plan and the reviews of any associated license amendment request had been transferred by memorandum dated July 21, 2017 (Agencywide Documents Access and Management System [ADAMS] Accession No. ML17089A344) to the Materials Decommissioning Branch in DUWP in the Office of Nuclear Material Safety and Safeguards (NMSS). Similarly, the safety inspection function was transferred from the Operational Fuel Facility Inspection Branch in the Division of Fuel Facility Inspection in Region II to the Decommissioning Inspection Branch in the Division of Nuclear Materials Safety in Region III.

Holahan, et al. 2 Overall project management functions for reviewing the safety, environmental protection and security of the LCF decommissioning plan were retained in the Division of Fuel Cycle Safety, Safeguards, and Environmental Review, while the information security inspection function was retained by Region II.

However, on June 27, 2019, citing a contract that was awarded on May 31, 2019, by the U.S.

Department of Energy for work involving Centrus Piketon facility, Centrus withdrew its August 9, 2018, request to terminate the LCF license (ADAMS Accession No. ML19186A272). By letter dated August 7, 2019 (ADAMS Accession No. ML19199A173), the NRC acknowledged Centrus June 27, 2019, withdrawal request and closed the corresponding NRC review action.

Notwithstanding this withdrawal, Centrus requested in a letter dated June 18, 2019 (ADAMS Accession No. ML19172A105), that the NRC complete its review and approval of the final status survey report (FSSR) submitted on April 19, 2018, to authorize the cancellation of decommissioning funding financial instrument for the LCF. On September 23, 2019, the NRC completed its review of the FSSR and concluded that the LCF facility meets the radiological criteria in Title 10 of the Code of Federal Regulations Section 20.1402 for unrestricted release of the facility (ADAMS Accession No. ML19228A096). This review considered survey information submitted by Centrus and the results of inspections by Region III decommissioning staff, including independent surveys by Oak Ridge Associated Universities, the NRCs contractor for decommissioning. Based on this approval, and a license condition that prohibits Centrus from receiving licensed material into the LCF without prior NRC approval, the NRC authorized cancellation of Centrus decommissioning funding financial instruments for the LCF (ADAMS Accession No. ML19238A138).

As of the date of this memorandum, all project management functions for the LCF license will reside with DFM and all inspection functions will reside with Region II.
