ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation (NOV) associated with a White Significance Determination Process (SDP) finding will be issued on or around March 14, 2011, to Exelon Generation Company, LLC (Licensee) as a result of an inspection at Byron Station, Unit 2.
This White finding, an issue with low to moderate safety significance, which may require additional NRC inspections, involved the Licensees failure to have appropriate acceptance criteria to ensure that a flange connection on the upper lube oil cooler of the 2A diesel generator was correctly torqued following maintenance. This led to the 2A diesel generator being inoperable beyond the allowed outage time of 14 days. The 2A diesel generator was inoperable since January 17, 2010 and the issue was identified when a significant oil leak developed during routine monthly surveillance testing on November 17, 2010.
An NOV is included based on the Licensees failure to meet 10 CFR Part 50, Appendix B, Criterion V, Instructions, Procedures and Drawings, which requires, in part, that instructions, procedures, or drawings shall include appropriate quantitative or qualitative acceptance criteria for determining that important activities have been satisfactorily accomplished. In accordance with the NRC Enforcement Policy, the NOV is considered an escalated enforcement action because it is associated with a White finding.
It should be noted that the licensee has not been specifically informed of the enforcement action.
