ISSUANCE OF FINAL SIGNIFICANCE DETERMINATION AND NOTICE OF VIOLATION This is to inform the Commission that a Notice of Violation associated with a White significance determination process finding will be issued on or around April 1, 2008, to Exelon Generation Company, LLC, as a result of inspections at Byron Station. This White finding, an issue of low to moderate safety significance which may require additional U.S. Nuclear Regulatory Commission inspection, involved degradation of the essential service water system riser piping at the cooling tower basin, and the subsequent dual unit shutdown on October 19, 2007, to correct the problem.
A Notice of Violation is included based on violations of 10 CFR Part 50, Appendix B, Criterion XVI, Corrective Actions, and 10 CFR Part 50, Appendix B, Criterion III, Design Control. Specifically, the licensee failed to take timely corrective actions after the identification of extensive corrosion on essential service water riser pipes and failed to verify the adequacy of the methodology and design inputs in calculations that supported the decision to accept three degraded essential service water riser pipes for continued service.
It should be noted that the licensee has not been specifically informed of the enforcement action. The schedule of issuance and notification is:
