Dear Mr. Parks:

The U.S. Nuclear Regulatory Commission (NRC) has approved the enclosed exemption from specific requirements of Title 10 of the Code of Federal Regulations (10 CFR) Paragraph 70.72(d)(2) and 70.72(d)3 for the Mixed Oxide Fuel Fabrication Facility.

This action is in response to your letter dated October 31, 2018 (Agencywide Documents Access and Management System [ADAMS] Accession Number ML18304A439), which requested an exemption based on a decision to terminate the construction authorization for the Mixed Oxide Fuel Fabrication Facility.

In accordance with 10 CFR Section 2.390 of the NRC's "Agency Rules of Practice and Procedure," a copy of this letter will be available electronically for public inspection in t he NRC Public Document Room or from the Publically Available Records component of the NRC's ADAMS. ADAMS is accessible from the NRC Web Site at http://www.nrc.gov/reading
