ST. LUCIE NUCLEAR PLANT: ALLEGED DISCRIMINATION AGAINST AN I&C TECHNICIAN FOR REPORTING SAFETY CONCERNS (CASE NO. 2 008/RII-95-A-0026)
Attached for your review is a letter from the alleger in this matter, Gary L.
PHIPPS. The letter documents PHIPPS' complaint to the U.S. Department of Labor (DOL) that he was illegally discriminated against by the respondent and NRC licensee, Florida Power & Light Company. Mr. PHIPPS' letter was also provided to Region II EICS and it is possible you may have reviewed it previously.
By letter dated September 8, 1995, the DOL Wage & Hour Division notified counsel for the respondent that the Wage & Hour Division found that protected activity by PHIPPS was "a factor" in the perceived discriminatory treatment PHIPPS claims to have suffered. A copy of the Wage & Hour letter is also attached. ,
By mutual agreement with the alleger, he was not previousif interviewed by 01 pending the outcome of the Wage & Hour investigation. It would be appreciated if you would provide this office with your assessment of the alleger's
