FENOC a nd the Staff ha ve timely responde d to the orig inal contention motion.B. A Change of Circum stances Has Occurr ed Which Militates A gainst Pr ocee din g on May 18 Shortly afte r the e ntry of the B oard's order , FEN OC  promulga ted its idea of a n ag ing manag ement plan (AMP) to addre ss the shield building cr acking issue, on April 5, 2012. .
I nterve nors have until J une 4, 2012 by which  time to move to amend or supplement their proposed Contention 5 based upon this disclosure by FEN OC, and I nterve nors wish to avail themselves of tha t option. Also, I nterve nors, hoping to acc eler ate the disc overy proce ss in order to reinfor ce the ir proposed c ontention, tendere d a F OI A re quest to the NRC in J anuar y 2012, and curr ently awa it the NRC's provision of requeste d information re lated to the cr acking issue.On May 14, 2012 (date of filing of this Motion), repre sentatives of the I nterve nors con-fer red w ith counsel for the NRC St aff and F ENOC on the matter of whe ther ora l arg ument on May 18 would be a pr oductive use of the ASL B's and par ties' time. Procee ding w ith oral arg ument on May 18  would risk wasting the B oard's time on a matter whic h is not li kely to be ripe on May 18 for r esolution. I n the intere st of conser ving judicia l resourc es, I nterve nors reque st that the Boa rd vac ate the Ma y 18, 2012 oral a rg ument and re schedule the same to a date when the pr oposed Contention 5 may be fina lly considere d for a dmissibi lity to this proceeding. Both the N RC S taff's counsel and F ENOC's counse l stated during the May 14 consulta-tion that they do not oppose this request.
