PROCEEDINGS CHAIRMAN HANSON: Thank you operator. Good afternoon, I am Christopher Hanson, Chairman of the Nuclear Regulatory Commission, and I am presiding over this public affirmation session, which is being conducted by teleconference.

Madam Secretary, I believe we have one item for affirmation. Would you please lead the Commission through?

ANNETTE VIETTI-COOK: Yes, todays item is SECY-21-0022, Holtec International (Hi-Store Consolidated Interim Storage Facility), Fasken Land and Minerals Appeal of Licensing Board Panel-20-10 and Motion to Reopen.

The Commission is being asked to act on a Memorandum and Order addressing an appeal by Fasken Land and Minerals, Ltd. and Permian Basin Land and Royalty Owners (together, Fasken) of the Atomic Safety and Licensing Boards decision denying Faskens

4 motion to reopen the record and admit an amended contention, and to address Faskens motion to reopen the record and admit its proposed Contention 3.

The Commission has voted to approve a Memorandum and Order denying Faskens appeal of Licensing Board Panel2010 and its motion to reopen the record.
