havailabilityoftheCommission'sFinalEnvironmentalStatementfortheGinnafacilitywaspublished.OnrDecember'20,1973,.thefirstoftenamendmentstotheApplicationwasfiled.*OnMarch12,1974,followingseveralpostponementsiapre-hearingconferencewasheld.ThatsamedayintervenorMichaelSladefiledrevisions-tohispetitiontointervene.Atthepre-hearingconference,theBoardgrantedMr.Sladetheopportunitytorevise,andresubmithiscontentions.AlsoonMarch12,1974,RCSIandLicensee.reachedastipula-tionterminatingtheproceeding.astoRCSI,whichwasfiledwiththeBoardonMarch13,1974.OnMarch26,1974,theStafffiledamotionforBoardapprovalofanattached,stipulationrelatingtoadmissionofcontentionsbetweeninterven'orMichaelSladeandtheStaff.OnApril5,1974,LicenseeopposedacceptanceoftheStaff'smotion,movedtostrikeMr.Slade'scontentions,andmovedtodismisshisintervention.ItalsofiledananswertotheStaff'smotionforapprovalbytheBoardofthestipulationrelatingtothe.admissionof'ontentions.OnApril22,1974,intervenorMichaelSladereplied,toApplicant'smotionof.April5,1974;',OnApril24;1974,theStaffrepliedto*ThelatestamendmenttotheApplicationwasfiledJuly6,1979.

Licensee'soppositiontothestipulationandmovedtodenyLicensee'smotiontodismiss.lOnMarch25,1977,theBoardissueditsorderrulingonthecontentionsofintervenorMichaelSladeanddeniedLicensee'smotiontodismissMr.Slade'sintervention.Itsetforththecontentionsadmittedintheproceedingand,treaffirmedtheparticipationoftheStateofNewYorkasan,interestedstatepursuantto10C.F.R.52.715(c).'nDecember13,1977,theCommissioninformedLicenseethattheGinnastationwastobeincludedintheCommission's,SystematicEvaluationProgram("SEP")fornuclear-poweredfacilities,resultsofwhichwouldprovideanadequatebasisfordecisionsregardingfull-termlicenses,andthattheconversionofallremainingprovisionaloperatinglicensestofull-termlicenseswouldawaitcompletionoftheSEP.ByletterofDecember13,1977,totheBoard,theStaffproposedtoinitiatediscussionswithLicenseeandMr.SladeontheimpactoftheSEPontheproceeding.Licenseeisunawarethattherehavebeenanysuchdiscussions.OnDecember14,1979,LicenseeandRCSIfiledwiththeBoardastipulationconfirmingtheirearlierstipulationterminatingtheproceedingastoRCSIdatedMarch12,1974.ThisstipulationfurtherrelievedLicenseeofcertainrequirementswhichwerecontainedin,theearlierstipulation.

2.BasedontheorderoftheAtomicSafetyandLicensingBoarddatedMarch25,1977,thefollowingissuesremain:I1.Intervenor'sContentionAconcerningthe'dequacyofLicensee'sQualityAssuranceProgram;2.Intervenor'sContentionBthatLicenseehasnotdemonstratedconformancewiththeamendedECCScriteriaasdeterminedbyAECDocketK1-50-1.3.Intervenor'sContentionDconcerningLicensee'sallegedviolationofapplicablefederalandNewYorkStatewaterqualitystandards.4.Intervenor'sContentionEthattheenvironmentalanalysisforthisfacilityisinadequatebecauseitfailstoconsiderthermaleffectsofdischargedwateronlake.biota.5.Intervenor'sContentionFthattheFESisinadequatebecauseitfailstotreatenergy'conservationalternatives.6..IntervenorsContentionIthatthesitecontingencyplanisinadequate.7.Intervenor'sContentionJthatLicenseehasfailedtoprovideadequatefloodprotection.8.Intervenor'sContentionKthatLicensee'sradwastesystemsmanagementprogramisinadequate.

I AcopyoftheBoard'sorder,settingforththesecontentionsindetail,isattached.3.Thepartiesremaininginthisproceedingare:1a)Licensee;b)theNuclearRegulatoryCommissionStaff;c)Mr.MichaelSlade,Intervenor;andd)theStateofNewYork.PursuanttostipulationsfiledMarch12,1974,andDecember14,1979,theRCSIhasindicateditsintentiontoterminateitsparticipationintheproceeding.4.Licensee'sunderstandingofthefuture'courseofactionintheseproceedingsisthattheStaffwillissueaSafetyEvaluationReport("SER")followingcompletionoftheSEP.NeunderstandthatthetargetdateforsuchcompletionisApril1982.Accordingly,Licenseesuggeststhefollowingschedule:a)twomonthsfollowingissuanceoftheStaffSER,theAdvisoryCommitteeonReactorSafeguards("ACRS")meet,makeitsdeterminations",andissueitsletterregardingitsfindingswithintwoweeksthereafter;b).anynecessary'supplementtotheSERbeissuedbytheStafftwomonthsfollowingreceiptoftheACRSletter;

c)alldiscoverybypartiesbeterminatedwithinonemonthfollowingtheissuanceofanynecessarySERsupplement;d)anyfurtherpre-hearingconferences.necessaryatthattimetakeplacewithinonemonthfollowingsupplementationoftheSER."e)thehearingshouldfollowassoont'hereafter,aspossible;f)aninitialdecisionbeissuedwithintwomonthsfollowingthecompletionofthehearing;andg)assumingthattheinitialdecisionis'favorable,afull-termoperatinglicensebeissuedimmediatelythereafter.Licenseerecommends.thatinlihtof'he5ggStaff'scommitmenttopursuecompletionoftheSEPpriortoissuanceofanSER,nothingneedbedoneinthismatteruntilsuchdateastheSEPreviewhasbeen'completed.Thereafter,Licenseerecommendstheschedulesuggestedinparagraph4.bepursued.Licenseealsorecommendsthatthe
