Licensee'soppositiontothestipulationandmovedtodenyLicensee'smotiontodismiss.lOnMarch25,1977,theBoardissueditsorderrulingonthecontentionsofintervenorMichaelSladeanddeniedLicensee'smotiontodismissMr.Slade'sintervention.Itsetforththecontentionsadmittedintheproceedingand,treaffirmedtheparticipationoftheStateofNewYorkasan,interestedstatepursuantto10C.F.R.52.715(c).'nDecember13,1977,theCommissioninformedLicenseethattheGinnastationwastobeincludedintheCommission's,SystematicEvaluationProgram("SEP")fornuclear-poweredfacilities,resultsofwhichwouldprovideanadequatebasisfordecisionsregardingfull-termlicenses,andthattheconversionofallremainingprovisionaloperatinglicensestofull-termlicenseswouldawaitcompletionoftheSEP.ByletterofDecember13,1977,totheBoard,theStaffproposedtoinitiatediscussionswithLicenseeandMr.SladeontheimpactoftheSEPontheproceeding.Licenseeisunawarethattherehavebeenanysuchdiscussions.OnDecember14,1979,LicenseeandRCSIfiledwiththeBoardastipulationconfirmingtheirearlierstipulationterminatingtheproceedingastoRCSIdatedMarch12,1974.ThisstipulationfurtherrelievedLicenseeofcertainrequirementswhichwerecontainedin,theearlierstipulation.

2.BasedontheorderoftheAtomicSafetyandLicensingBoarddatedMarch25,1977,thefollowingissuesremain:I1.Intervenor'sContentionAconcerningthe'dequacyofLicensee'sQualityAssuranceProgram;2.Intervenor'sContentionBthatLicenseehasnotdemonstratedconformancewiththeamendedECCScriteriaasdeterminedbyAECDocketK1-50-1.3.Intervenor'sContentionDconcerningLicensee'sallegedviolationofapplicablefederalandNewYorkStatewaterqualitystandards.4.Intervenor'sContentionEthattheenvironmentalanalysisforthisfacilityisinadequatebecauseitfailstoconsiderthermaleffectsofdischargedwateronlake.biota.5.Intervenor'sContentionFthattheFESisinadequatebecauseitfailstotreatenergy'conservationalternatives.6..IntervenorsContentionIthatthesitecontingencyplanisinadequate.7.Intervenor'sContentionJthatLicenseehasfailedtoprovideadequatefloodprotection.8.Intervenor'sContentionKthatLicensee'sradwastesystemsmanagementprogramisinadequate.
