By letters dated March 23, 2021 (Agencywide Documents Access and Management System
{ADAMS} Accession No. ML21105A528), and July 26, 2021 (ADAMS Accession No. ML21244A483), the Department of Energy, Naval Reactors submitted applications for amendment and renewal of Certificate of Compliance No. 9793, for the Model No. M-140 transportation package. The two applications for amendment include revision to the D2W and S6W spent fuel and associated thermal restrictions; and S3G-3 spent fuel along with shipment of the spent fuel from the Moored Training Ship (DANIEL WEBSTER (MTS 626) and SAM RAYBURN (MTS 626)). Since Naval Reactors submitted the request for package renewal at least 30 days in advance of the expiration date, the certificate of compliance is in timely renewal and, therefore, in accordance with your request, the U.S. Nuclear Regulatory Commission will renew the package when it issues the next amendment.
This letter informs you that the applications appear to contain the necessary information to begin our technical review. Based on our discussions with Naval Rectors, we have established schedules for the technical reviews of your amendment requests, which prioritize review of the S3G-3 spent fuel. The schedule for the S3G-3 allows for the staff to issue a possible request for additional information by mid- March 2022, and a certificate of compliance and safety evaluation report by the end of July 2022, based on Naval Reactors responding to the NRCs request for additional information by mid-May 2022. If no additional information is needed beyond your application, the certificate of compliance and safety evaluation report may be issued in mid-April 2022. The staff estimates that completing the safety review of this application will require approximately 500 staff hours.
The schedule for the D2W and S6W spent fuel amendment allows for the staff to issue a possible request for additional information first week in July 2022, and a certificate of compliance and safety evaluation report the first week in January 2023, based on Naval Reactors responding to the NRCs request for additional information the first week of September 2022. The staff estimates that completing the safety review of this application will require approximately 600 staff hours and no contractor charges.
