U.S. NUCLEAR REGULATORY COMMISSION REVIEW OF EXPORT LICENSE APPLICATION XSNM3702/01
Dear Ms. McBride-Lovas:
I am writing to update you on the status of Westinghouse Electric Company, LLC (WEC) export license application (XSNM3702/01). The U.S. Nuclear Regulatory Commission (NRC) has received the final Executive Branch (EB) judgement on April 17, 2020, authorizing the NRC to issue the license amendment for the export to China of a total number of 51 Intermediate Range Core detectors, each containing a maximum of 6 grams of HEU for a total of 285.15 grams of uranium-235 (enriched to 93.19 WGT % maximum), in 306 grams uranium, for use in the Westinghouse AP1000 Haiyang and Sanmen Nuclear Power Plants. The NRC has completed all the licensing actions necessary to issue the license. On May 6, 2020, during a conference call, WEC requested that the NRC not issue the license until all of the ongoing inter-agency policy discussions and decisions associated with the U.S. Policy Framework on Civil Nuclear Cooperation with China are completed.
Title 10 of the Code of Federal Regulations (10 CFR) 110.40(d), states in part, if the Commission has not completed action on a license application within 60 days after receipt of the EB judgement, the NRC is required to inform the applicant in writing of the reason for the delay.
