MINOR AMENDMENTS TO 10 CFR PART 110 " EXPORT AND IMPORT OF NUCLEAR MATERIALS AND EQUIPMENT" Attached for your sigriature is a Federal Register Notice amending 10 CFR Part 110, " Export and Import of Nuclear Materials and Equipment," (1) to impose notification requirements on certain licensees for exports of Canadian-origin nuclear materials or equipment; (2) to expand the general license for ex americium-241 contained in industrial process control equipment; and (3) ports to of update the list of countries in 9110.29, Restricted destinations, to delete certain recent adherents to the Nuclear Non-Proliferation Treaty (Enclosure 1).
This rule further simplifies the Part 110 licensing requirements for the export of certain minor quantities of nuclear material. The amendment imposing notification requirements on certain license holders is required to implement a part of the U.S./ Canada Agreement for Cooperation. Expanding the export of americium-241 corrects an oversight in the current general license regulations for this material. Updating the list of restricted destinations is a technical revision with minimal impact on the public.
No backfit analysis as required by 10 CFR !i50.109 has been prepared for these amendments, since the regulations in Part 110 apply only to export and import of nuclear facilities, material and components and have no impact on domestic facilities.
Because these amendments involve a foreign affairs function of the United States, the Administrative Procedure Act provisions governing rulemaking do not      '
apply to this action (5 U.S.C. 553 (a)(1)). Therefore, a notice of proposed rulemaking is not required for this action, and we recommend that the final rule become effectiva upon publication in the Federal Register.
Notices: A notice to the Commission that the ED0 has signed this rule is enclosed for inclusion in the next Daily Staff Notes (Enclosure 2). The appropriate Congressional Comittees will be notified (Enclosure 3).
