REGULATIONS FOR THE EXPORT OF NUCLEAR MATERIAL AND EQUIPMENT c

The Division of Rules and Records, Office of Administration, has reviewed the final rule that covers several amendments to Part 110 pertaining to the export of nuclear material and equipment. We have inserted a marked-up copy of the package that sets out our comments.

An agency is generally required by the Administrative Procedure Act to publish 4

a notice of proposed rulemaking before issuing the document in final form and to delay the effective date of the final rule for at least 30 days after the rule is published in the Federal Register. However, an agency may waive these requirements if the rulemaking action meets the exemptions specified in the Act and the final rule contains a statement indicating the exemption under which the agency waives these requirements. We have inserted suggested language in the final rule to indicate the required waiver. This language must be coordinated with and approved by ELD.

Since the publication of the backfit rule on September 20, 1985 (50 FR 38097),

the Commission is requiring that each rule or proposed rule be accompanied by a backfit analysis. The Commission is also requiring that the text of the backfit analysis and a statement of the determination made by the backfit analysis be included in the text of the rulemaking document. We have inserted a suggested model statement. You should coordinate the contents of the backfit analysis and the appropriateness of the suggested determination with ELD.

When the document is submitted to the ED0 for signature and publication, the package should be included under a cover memorandum to the ED0 patterned after the sample memorandum set out on pages 295 and 296 of the NRC Regulations Handbook.

We have forwarded a copy of the final rule to the Document Management Branch, TIDC, for their comment / concurrence concerning the paperwork management
