Dear Mr. Stoiber:
NRC has been requested by KAY-RAY Inc. (see enclosed letter) to amend 10CFR Part 110 to pemit the export under general license of americium-241 in certain industrial neutron sources. The NRC staff has reviewed this request and believes that such a modification would be appropriate and would not be of proliferation significance. If acceptable to the Executive Branch, we will propose the adoption of the following ame' : ment to the americium-24 general license in 5110.23(b)(1):
5110.23 Export of byproduct materic1.
(a)
(b) A general license is issued to any person to export americium-241 to any country not listed in s110.28, except that exports of ameristum-241 exceeding one curie per shipment or 100 curies por year to any country countries listed in 5110.29 -

Please advise if the proposed amendment is acceptable from the Executive Branch's standpoint. Should there be any questions, I would propose that this matter be placed on the SNEC agenda for further discussion.
