}                              Township Environmental Commission (Petitioner) has passed a resolution j                              opposing transfer of spent nuclear fuel from wet to dry storage during operation of Oyster Creek Nuclear Generating Station (OCNGS).                  Petitioner requests that the U.S. Nuclear Regulatory Commission (NRC) direct GPU Nuclear                                        !
(GPU) to shut down the nuclear reactor at OCNGS during the aforementioned fuel t

isolation condensers and the torus, creating the possibility of an unisolable leak, which in industry jargon describes a situation perilously close to a                                          l 1
nuclear meltdown; (3) the operating record of GPU demonstrates it is capable of human error, including dropping heavy loads; (4) Bcrkeley Township could not be successfully evacuated in the event of a serious nuclear accident at OCNGS; and (5) the safer simpler alterative of turning off the reactor while lifting 100-ton loads.over the containment can be easily implemented.                                                ;

WHEREAS the managers of the Wster Creek Nuclear Generating Station have stated p dlicly that they intend to leave oyster Creek's nuclear reactor running while moving 100 ton loads of spent nuclear fuel from wet storage to dry storage; and WHEREAS the load path for these 100 ton fuel transfers pasues 119 feet over the reactor's containment mechanism and other safety related equipment; and WHEREAS the Nuclear Regulatory Commission Bulletin 96-02, dated April 11 1996, states that "a cask drop could damage both isolation, condensers and the torus, possibly
                    ,  creating an unisolable loss of coolant accident outside containment"; and WHEREAS "an unisolable loss of coolant accident outside containment" is industry jargon describing a situation perilously close to a nuclear meltdown; and WHEREAS the operating record of GPU Nuclear demonstrates that they, like any other human beings, are capable of human error, including dropping heavy loads; and                                '
WHEREAS it is the opinion of this Environmental Commission that Berkeley Township could never be successfully evacuated in the event of a serious accident at Oyster Creek; and WHEREAS the safer and simpler alternative of turning the nuclear reacter off while lifting 100 ton loads over the containment can be easily implemented.
NOW, THEREFORE, BE IT RESOLVED that the Berkeley Township Environmental Commission respectfully requests of the Honorable Shirley Jackson, Chairman of the Nuclear Regulatory Commission that she direct GPU Nuclear to shut down the nuclear reactor at the oyster Creek Nuclear Generating Station during the transfer of fuel from wat to dry storage. . -
