Purpose of the Meeting: To discuss with TVA specific comments received from American Indian Tribes on the Draft Environmental Impact Statement (DEIS) for an Early Site Permit (ESP) at the Clinch River Nuclear Site that are pertinent to TVAs ongoing NHPA Section 106 consultations.
Summary of Meeting: On October 23, 2018, a closed meeting was held between the NRC and representatives of TVA. The purpose of the meeting was to discuss with TVA specific comments from American Indian Tribes on the DEIS for an ESP at the Clinch River Nuclear Site that are pertinent to TVAs ongoing NHPA Section 106 consultation considerations. Most comments provided by Tribes are pertinent to TVAs undertaking and do not apply to NRCs current undertaking associated with the ESP. Should TVA choose to move forward with this project, these comments and concerns would be applicable to TVAs NHPA Section 106 considerations as well as part of NRCs potential future review of a combined license application. NRC communicated these concerns to TVA during this teleconference. NRC staff agreed to copy TVA on NRCs formal responses to Tribes. The NRC will document these comments at a high-level in the Final EIS for the purposes of retaining NRCs NHPA Section 106 administrative record for the ESP.
Topics discussed resulted from NRCs consultation with the Seminole Nation of Oklahoma, the Cherokee Nation, and Thlopthlocco Tribal Town.
NRC also inquired about TVAs timing for implementing its programmatic agreement (PA) should TVA pursue a COL application. TVA representatives stated that if it decides to pursue a COL application that the PA would be part of the COLA process and would be implemented along with TVAs NEPA process.
