SUMMARY

Title:

Meeting between the U.S. Nuclear Regulatory Commission (NRC) and Tennessee Valley Authority (TVA) to Discuss Topics Associated With Comments on the Draft Environmental Impact Statement for an Early Site Permit at the Clinch River Nuclear Site [Cultural Resources]

To discuss TVA comments on the Draft Environmental Impact Statement (DEIS) for an Early Site Permit (ESP) at the Clinch River Nuclear Site as well as comments received from American Indian Tribes.

The specific topics discussed were outlined in an attachment to the meeting notice under Related Documents (ADAMS Accession No. ML18220B385) and were as follows:

Clarification regarding TVA DEIS comments associated with Section 2.7.2.1, page 2-146 (ML18180A386)

Discussion regarding American Indian Tribal consultation letters from the Seminole Nation of Oklahoma and the Cherokee Nation regarding requests for cultural resource survey reports. (ML18194A380 and ML18199A044)

Discussion regarding American Indian Tribal consultation letters from the Seminole Nation of Oklahoma regarding request for face-to-face meeting with project proponent to discuss project plans.

Summary of Meeting The meeting started with brief introductions and identification of the callers, and an NRC overview of the meeting purpose.

Regarding the TVA comment on Section 2.7.2.1, TVA confirmed that there is a discrepancy in the documentation regarding archaeological site 40RE165. TVA stated that their archaeologist confirmed that it is acceptable to characterize 40RE165 as a pre-contact site. TVA intends to withdraw this comment.

Regarding the correspondence received from tribes, NRC staff stated that both the Seminole Nation of Oklahoma (Mr. Isham) and the Cherokee Nation (Ms. Toombs) have requested copies of the cultural resources survey reports associated with the CRN Site. NRC had received a

2 similar request from the Seminole Nation of Oklahoma during scoping. In response, NRC staff sent links to the redacted version of the cultural resource survey reports. NRC requested permission from TVA to send the un-redacted versions of the cultural survey reports to both tribes (unless TVA preferred to send the reports). TVA stated that they prefer that NRC send the reports, but to include Ms. Shuler (TVA tribal liaison) on the transmittal. Ms. Shuler also recommended that NRC send all consulting tribes copies of the un-redacted reports.1 TVA stated that it will provide Ms. Shulers email address to the NRC, so that she may be ccd on any information related to todays call that the staff provides to tribes.

NRC reported that the Mr. Isham of Seminole Nation of Oklahoma had also requested a face-to-face meeting and wondered if TVA had heard from the Seminole Nation regarding this request.

Ms. Shuler indicated that TVA communicates and consults with the Seminole Nation routinely, but not recently about the ESP. Ms. Horton of TVA stated that there is not an ongoing NEPA review for TVAs federal action for the proposed project. NRC staff explained that it plans to follow up with the Seminole Nation regarding its letter and will forward survey reports along with flora studies. Staff also plans to find out more from the Seminole regarding their request for a meeting with TVA. NRC stated that during the follow-up call with Mr. Isham, staff will inquire if he would like to have a meeting with TVA and will let Ms. Shuler know if that is the case. Ms.

Shuler indicated that TVA would be happy to facilitate this request if needed.

In keeping with NRCs approach to completing NHPA Section 106 though NEPA, pursuant to 36 CFR 800.8(c), details associated with the un-redacted cultural resource survey reports are provided in Section 2.7 of the DEIS.

Redacted copies of the reports are publicly available through ADAMS.
