ORDER (Denying NRC Staff Motion to Strike)
On August 11, 2014, this Board issued an order denying the Companies' motion to file additional exhibits.
1 On August 29, 2014, the Companies filed their written post-hearing statement of position, which included a request that the Commission reconsider the Board's August 11 order and which advanced arguments based on the non-admitted exhibits.
2 On September 3, 2014, the NRC Staff filed a motion that sought (1) to strike the above-mentioned portions of the Companies' post-hearing statement of position; or, in the alternative (2) to permit the Staff to provide a substantive response (which the Staff included in their motion) to the
Companies' arguments.
